66 AN ACT
77 relating to longevity pay for certain prosecutors.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 41.013, Government Code, is amended to
1010 read as follows:
1111 Sec. 41.013. COMPENSATION OF CERTAIN PROSECUTORS. Except
1212 as otherwise provided by law, a district attorney or criminal
1313 district attorney is entitled to receive from the state:
1414 (1) annual compensation in an amount equal to at least
1515 80 percent of the state annual salary as set by the General
1616 Appropriations Act in accordance with Section 659.012 paid to a
1717 district judge with comparable years of service as the district
1818 attorney or criminal district attorney; and
1919 (2) a monthly amount of longevity pay based on the
2020 district attorney's or criminal district attorney's years of
2121 service that would be paid to the district attorney or criminal
2222 district attorney under Section 659.0445 if the district attorney
2323 or criminal district attorney were a judge or justice described by
2424 Section 659.0445(a).
2525 SECTION 2. Section 46.003(a), Government Code, is amended
2626 to read as follows:
2727 (a) The state prosecuting attorney and each state
2828 prosecutor is entitled to receive from the state:
2929 (1) a salary in an amount equal to the state annual
3030 salary as set by the General Appropriations Act in accordance with
3131 Section 659.012 paid to a district judge with comparable years of
3232 service as the state prosecuting attorney or state prosecutor; and
3333 (2) a monthly amount of longevity pay based on the
3434 state prosecuting attorney's or state prosecutor's years of service
3535 that would be paid to the state prosecuting attorney or state
3636 prosecutor under Section 659.0445 if the state prosecuting attorney
3737 or state prosecutor were a judge or justice described by Section
3838 659.0445(a).
3939 SECTION 3. Sections 41.013 and 46.003(a), Government Code,
4040 as amended by this Act, apply beginning with the first pay period
4141 that begins on or after the effective date of this Act.
4242 SECTION 4. This Act takes effect September 1, 2023.
