55 relating to the classification of a grievance filed with the State
66 Bar of Texas.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 81.073, Government Code, is amended to
99 read as follows:
1010 Sec. 81.073. CLASSIFICATION OF GRIEVANCES. (a) The chief
1111 disciplinary counsel's office shall classify each grievance on
1212 receipt as:
1313 (1) a complaint, if the grievance:
1414 (A) alleges conduct that, if true, constitutes
1515 professional misconduct or disability cognizable under the Texas
1616 Disciplinary Rules of Professional Conduct; and
1717 (B) is submitted by:
1818 (i) a family member of a ward in a
1919 guardianship proceeding that is the subject of the grievance;
2020 (ii) a family member of a decedent in a
2121 probate matter that is the subject of the grievance;
2222 (iii) a trustee of a trust or an executor of
2323 an estate if the matter that is the subject of the grievance relates
2424 to the trust or estate;
2525 (iv) the judge, prosecuting attorney,
2626 defense attorney, court staff member, or juror in the legal matter
2727 that is the subject of the grievance;
2828 (v) a trustee in a bankruptcy that is the
2929 subject of the grievance; or
3030 (vi) any other person who has a cognizable
3131 individual interest in or connection to the legal matter or facts
3232 alleged in the grievance; or
3333 (2) an inquiry, if:
3434 (A) the grievance alleges conduct that, even if
3535 true, does not constitute professional misconduct or disability
3636 cognizable under the Texas Disciplinary Rules of Professional
3737 Conduct;
3838 (B) the grievance is submitted by a person other
3939 than a person described by Subdivision (1)(B); or
4040 (C) [(B)] the respondent attorney is deceased,
4141 has relinquished the attorney's license to practice law in this
4242 state to avoid disciplinary action, or is not licensed to practice
4343 law in this state.
4444 (b) A complainant or an attorney against whom a grievance is
4545 filed may appeal the classification of a grievance [as an inquiry]
4646 to the Board of Disciplinary Appeals, or the complainant may amend
4747 and resubmit the grievance. [An attorney against whom a grievance
4848 is filed may not appeal the classification of the grievance.]
4949 SECTION 2. Section 81.074, Government Code, is amended to
5050 read as follows:
5151 Sec. 81.074. DISPOSITION OF INQUIRIES. The chief
5252 disciplinary counsel shall:
5353 (1) dismiss a grievance classified as an inquiry; and
5454 (2) refer each inquiry classified under Section
5555 81.073(a)(2)(A) or (B) and dismissed under this section to the
5656 voluntary mediation and dispute resolution procedure established
5757 under Section 81.072(e).
5858 SECTION 3. The changes in law made by this Act apply only to
5959 a grievance filed on or after the effective date of this Act. A
6060 grievance filed before the effective date of this Act is governed by
6161 the law in effect on the date the grievance was filed, and the
6262 former law is continued in effect for that purpose.
6363 SECTION 4. This Act takes effect September 1, 2023.
