7 | 7 | | relating to the disposition of surplus real property no longer |

8 | 8 | | needed for state highway purposes. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Sections 202.021(d) and (h), Transportation |
---|
11 | 11 | | Code, are amended to read as follows: |
---|
12 | 12 | | (d) The commission shall: |
---|
13 | 13 | | (1) determine the fair value of the state's interest in |
---|
14 | 14 | | the real property; and |
---|
15 | 15 | | (2) if the value is $100,000 [$10,000] or more, advise |
---|
16 | 16 | | the governor of the value. |
---|
17 | 17 | | (h) If the commission determines that the value of the real |
---|
18 | 18 | | property is less than $100,000 [$10,000], it may authorize the |
---|
19 | 19 | | executive director to execute a deed conveying the state's interest |
---|
20 | 20 | | in the property without a recommendation to the governor. |
---|
21 | 21 | | SECTION 2. Section 202.030(a), Transportation Code, is |
---|
22 | 22 | | amended to read as follows: |
---|
23 | 23 | | (a) The attorney general must approve a transfer or |
---|
24 | 24 | | conveyance that is made under this subchapter if the value of the |
---|
25 | 25 | | real property transferred or conveyed is $100,000 [$10,000] or |
---|
26 | 26 | | more. |
---|
27 | 27 | | SECTION 3. The change in law made by this Act applies only |
---|
28 | 28 | | to an interest in real property that is recommended to the governor |
---|
29 | 29 | | for sale or transfer on or after the effective date of this Act. An |
---|
30 | 30 | | interest recommended to the governor for sale or transfer before |
---|
31 | 31 | | the effective date of this Act is governed by the law in effect |
---|
32 | 32 | | immediately before the effective date of this Act, and that law is |
---|
33 | 33 | | continued in effect for that purpose. |
---|
34 | 34 | | SECTION 4. This Act takes effect immediately if it receives |
---|
35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
---|
36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
---|
38 | 38 | | Act takes effect September 1, 2023. |
