55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the disposition of surplus real property no longer
88 needed for state highway purposes.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 202.021(d) and (h), Transportation
1111 Code, are amended to read as follows:
1212 (d) The commission shall:
1313 (1) determine the fair value of the state's interest in
1414 the real property; and
1515 (2) if the value is $100,000 [$10,000] or more, advise
1616 the governor of the value.
1717 (h) If the commission determines that the value of the real
1818 property is less than $100,000 [$10,000], it may authorize the
1919 executive director to execute a deed conveying the state's interest
2020 in the property without a recommendation to the governor.
2121 SECTION 2. Section 202.030(a), Transportation Code, is
2222 amended to read as follows:
2323 (a) The attorney general must approve a transfer or
2424 conveyance that is made under this subchapter if the value of the
2525 real property transferred or conveyed is $100,000 [$10,000] or
2626 more.
2727 SECTION 3. The change in law made by this Act applies only
2828 to an interest in real property that is recommended to the governor
2929 for sale or transfer on or after the effective date of this Act. An
3030 interest recommended to the governor for sale or transfer before
3131 the effective date of this Act is governed by the law in effect
3232 immediately before the effective date of this Act, and that law is
3333 continued in effect for that purpose.
3434 SECTION 4. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2023.
