| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter A, Chapter 531, Government Code, is |
|---|
| 12 | 12 | | amended by adding Section 531.0185 to read as follows: |
|---|
| 13 | 13 | | Sec. 531.0185. SUBCONTRACTOR INFORMATION CLAUSE. (a) The |
|---|
| 14 | 14 | | commission shall include in each contract the commission enters |
|---|
| 15 | 15 | | into a clause that requires any contractor to disclose the |
|---|
| 16 | 16 | | following information relating to any subcontractor under the |
|---|
| 17 | 17 | | contract: |
|---|
| 18 | 18 | | (1) the process the contractor uses to select |
|---|
| 19 | 19 | | subcontractors; |
|---|
| 20 | 20 | | (2) the number of persons who submit subcontractor |
|---|
| 21 | 21 | | proposals to the contractor and the name of each person who: |
|---|
| 22 | 22 | | (A) submits a proposal to be a subcontractor; and |
|---|
| 23 | 23 | | (B) is awarded a subcontract under the contract; |
|---|
| 24 | 24 | | and |
|---|
| 25 | 25 | | (3) the reasons for the contractor's selection of one |
|---|
| 26 | 26 | | subcontractor over another subcontractor. |
|---|
| 27 | 27 | | (b) Not later than September 1 of each year, the commission |
|---|
| 28 | 28 | | shall submit a report to the legislature and the presiding officer |
|---|
| 29 | 29 | | of each legislative standing committee with jurisdiction over the |
|---|
| 30 | 30 | | commission that includes a summary of the information collected |
|---|
| 31 | 31 | | from reports submitted under this section. |
|---|
| 32 | 32 | | SECTION 2. Section 531.0185, Government Code, as added by |
|---|
| 33 | 33 | | this Act, applies only to a contract entered into on or after the |
|---|
| 34 | 34 | | effective date of this Act. A contract entered into before the |
|---|
| 35 | 35 | | effective date of this Act is governed by the law in effect on the |
|---|
| 36 | 36 | | date the contract was entered into, and the former law is continued |
|---|
| 37 | 37 | | in effect for that purpose. |
|---|
| 38 | 38 | | SECTION 3. This Act takes effect September 1, 2023. |
