88 contractors to report certain information regarding
99 subcontractors.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 531, Government Code, is
1212 amended by adding Section 531.0185 to read as follows:
1313 Sec. 531.0185. SUBCONTRACTOR INFORMATION CLAUSE. (a) The
1414 commission shall include in each contract the commission enters
1515 into a clause that requires any contractor to disclose the
1616 following information relating to any subcontractor under the
1717 contract:
1818 (1) the process the contractor uses to select
1919 subcontractors;
2020 (2) the number of persons who submit subcontractor
2121 proposals to the contractor and the name of each person who:
2222 (A) submits a proposal to be a subcontractor; and
2323 (B) is awarded a subcontract under the contract;
2424 and
2525 (3) the reasons for the contractor's selection of one
2626 subcontractor over another subcontractor.
2727 (b) Not later than September 1 of each year, the commission
2828 shall submit a report to the legislature and the presiding officer
2929 of each legislative standing committee with jurisdiction over the
3030 commission that includes a summary of the information collected
3131 from reports submitted under this section.
3232 SECTION 2. Section 531.0185, Government Code, as added by
3333 this Act, applies only to a contract entered into on or after the
3434 effective date of this Act. A contract entered into before the
3535 effective date of this Act is governed by the law in effect on the
3636 date the contract was entered into, and the former law is continued
3737 in effect for that purpose.
3838 SECTION 3. This Act takes effect September 1, 2023.
