99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the boundaries of the single-member districts for and
1212 vacancies on the board of directors of the Hays Trinity Groundwater
1313 Conservation District.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Section 8843.056(c), Special District Local Laws
1616 Code, is amended to read as follows:
1717 (c) When the boundaries of the single-member districts are
1818 changed [At the first election after the single-member districts
1919 are revised], a [new] director in office on the effective date of
2020 the change, or elected or appointed before the effective date of the
2121 change to a term of office beginning on or after the effective date
2222 of the change, is entitled to serve the term or the remainder of the
2323 term in the single-member district to which the director was
2424 elected or appointed even though the change in boundaries places
2525 the director's residence outside the single-member district for
2626 which the director was elected or appointed [shall be elected from
2727 each district. The directors shall draw lots to determine which two
2828 directors serve one-year terms and which three directors serve
2929 two-year terms].
3030 SECTION 2. Section 8843.055, Special District Local Laws
3131 Code, is repealed.
3232 SECTION 3. The selection of terms of the board of directors
3333 that occurred before the effective date of this Act and in
3434 accordance with Section 8843.056(c), Special District Local Laws
3535 Code, is validated and confirmed.
3636 SECTION 4. The change in law made by this Act applies only
3737 to a change in the boundaries of the single-member districts from
3838 which the members of the board of directors of the Hays Trinity
3939 Groundwater Conservation District are elected that is made on or
4040 after the effective date of this Act. A change in the boundaries of
4141 the single-member districts that is made before the effective date
4242 of this Act is governed by the law as it existed immediately before
4343 the effective date of this Act, and that law is continued in effect
4444 for that purpose.
4545 SECTION 5. (a) The legal notice of the intention to
4646 introduce this Act, setting forth the general substance of this
4747 Act, has been published as provided by law, and the notice and a
4848 copy of this Act have been furnished to all persons, agencies,
4949 officials, or entities to which they are required to be furnished
5050 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
5151 Government Code.
5252 (b) The governor, one of the required recipients, has
5353 submitted the notice and Act to the Texas Commission on
5454 Environmental Quality.
5555 (c) The Texas Commission on Environmental Quality has filed
5656 its recommendations relating to this Act with the governor, the
5757 lieutenant governor, and the speaker of the house of
5858 representatives within the required time.
5959 (d) All requirements of the constitution and laws of this
6060 state and the rules and procedures of the legislature with respect
6161 to the notice, introduction, and passage of this Act are fulfilled
6262 and accomplished.
6363 SECTION 6. This Act takes effect September 1, 2023.
