| 11 | 11 | | relating to the boundaries of the single-member districts for and |

| 12 | 12 | | vacancies on the board of directors of the Hays Trinity Groundwater |
|---|
| 13 | 13 | | Conservation District. |
|---|
| 14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 15 | | SECTION 1. Section 8843.056(c), Special District Local Laws |
|---|
| 16 | 16 | | Code, is amended to read as follows: |
|---|
| 17 | 17 | | (c) When the boundaries of the single-member districts are |
|---|
| 18 | 18 | | changed [At the first election after the single-member districts |
|---|
| 19 | 19 | | are revised], a [new] director in office on the effective date of |
|---|
| 20 | 20 | | the change, or elected or appointed before the effective date of the |
|---|
| 21 | 21 | | change to a term of office beginning on or after the effective date |
|---|
| 22 | 22 | | of the change, is entitled to serve the term or the remainder of the |
|---|
| 23 | 23 | | term in the single-member district to which the director was |
|---|
| 24 | 24 | | elected or appointed even though the change in boundaries places |
|---|
| 25 | 25 | | the director's residence outside the single-member district for |
|---|
| 26 | 26 | | which the director was elected or appointed [shall be elected from |
|---|
| 27 | 27 | | each district. The directors shall draw lots to determine which two |
|---|
| 28 | 28 | | directors serve one-year terms and which three directors serve |
|---|
| 29 | 29 | | two-year terms]. |

| 30 | 30 | | SECTION 2. Section 8843.055, Special District Local Laws |
|---|
| 31 | 31 | | Code, is repealed. |
|---|
| 32 | 32 | | SECTION 3. The selection of terms of the board of directors |
|---|
| 33 | 33 | | that occurred before the effective date of this Act and in |
|---|
| 34 | 34 | | accordance with Section 8843.056(c), Special District Local Laws |
|---|
| 35 | 35 | | Code, is validated and confirmed. |
|---|
| 36 | 36 | | SECTION 4. The change in law made by this Act applies only |
|---|
| 37 | 37 | | to a change in the boundaries of the single-member districts from |
|---|
| 38 | 38 | | which the members of the board of directors of the Hays Trinity |
|---|
| 39 | 39 | | Groundwater Conservation District are elected that is made on or |
|---|
| 40 | 40 | | after the effective date of this Act. A change in the boundaries of |
|---|
| 41 | 41 | | the single-member districts that is made before the effective date |
|---|
| 42 | 42 | | of this Act is governed by the law as it existed immediately before |
|---|
| 43 | 43 | | the effective date of this Act, and that law is continued in effect |
|---|
| 44 | 44 | | for that purpose. |
|---|
| 45 | 45 | | SECTION 5. (a) The legal notice of the intention to |
|---|
| 46 | 46 | | introduce this Act, setting forth the general substance of this |
|---|
| 47 | 47 | | Act, has been published as provided by law, and the notice and a |
|---|
| 48 | 48 | | copy of this Act have been furnished to all persons, agencies, |
|---|
| 49 | 49 | | officials, or entities to which they are required to be furnished |
|---|
| 50 | 50 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
|---|
| 51 | 51 | | Government Code. |
|---|
| 52 | 52 | | (b) The governor, one of the required recipients, has |
|---|
| 53 | 53 | | submitted the notice and Act to the Texas Commission on |
|---|
| 54 | 54 | | Environmental Quality. |
|---|
| 55 | 55 | | (c) The Texas Commission on Environmental Quality has filed |
|---|
| 56 | 56 | | its recommendations relating to this Act with the governor, the |
|---|
| 57 | 57 | | lieutenant governor, and the speaker of the house of |
|---|
| 58 | 58 | | representatives within the required time. |
|---|
| 59 | 59 | | (d) All requirements of the constitution and laws of this |
|---|
| 60 | 60 | | state and the rules and procedures of the legislature with respect |
|---|
| 61 | 61 | | to the notice, introduction, and passage of this Act are fulfilled |
|---|
| 62 | 62 | | and accomplished. |
|---|
| 63 | 63 | | SECTION 6. This Act takes effect September 1, 2023. |
