66 AN ACT
77 relating to requirements for a juvenile's appearance in a judicial
88 proceeding.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 54, Family Code, is amended by adding
1111 Sections 54.12 and 54.13 to read as follows:
1212 Sec. 54.12. USE OF RESTRAINTS. (a) A mechanical or
1313 physical restraint may not be used on a child during a judicial
1414 proceeding and any restraint must be removed before the child's
1515 appearance before the court unless the court finds that:
1616 (1) the use of a mechanical or physical restraint is
1717 necessary:
1818 (A) to prevent physical injury to the child or
1919 another person;
2020 (B) because the child has a history of disruptive
2121 courtroom behavior that has placed others in potentially harmful
2222 situations; or
2323 (C) because the child presents a substantial risk
2424 of flight from the courtroom; and
2525 (2) the mechanical or physical restraint used is the
2626 least restrictive restraint effective to prevent the child's escape
2727 or physical injury to the child or another person.
2828 (b) The court shall provide the child's attorney an
2929 opportunity to be heard before the court may order the use of a
3030 mechanical or physical restraint. If the use of a restraint is
3131 ordered, the court shall make findings of fact in support of the
3232 order.
3333 Sec. 54.13. CLOTHING DURING JUDICIAL PROCEEDING. (a)
3434 Except as provided by Subsection (b), during a judicial proceeding,
3535 a court shall permit a child to wear clothing other than a uniform
3636 provided by a detention or correctional facility if:
3737 (1) the child's attorney requests the court's
3838 permission for the child to wear other clothing; and
3939 (2) the child's attorney or family member provides the
4040 child with appropriate clothing.
4141 (b) The court may deny an attorney's request under
4242 Subsection (a) only if the court finds that granting the request
4343 would present:
4444 (1) a substantial risk of the child's flight from the
4545 courtroom; or
4646 (2) a safety risk to the child or another person.
4747 SECTION 2. This Act takes effect September 1, 2023.
