55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the governor's power to control the sale, dispensing,
88 transportation, storage, and use of alcoholic beverages,
99 explosives, and combustibles during a declared state of disaster or
1010 state of emergency.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 433.002(b), Government Code, is amended
1313 to read as follows:
1414 (b) The directive may provide for:
1515 (1) control of public and private transportation in
1616 the affected area;
1717 (2) designation of specific zones in the affected area
1818 in which, if necessary, the use and occupancy of buildings and
1919 vehicles may be controlled;
2020 (3) control of the movement of persons;
2121 (4) control of places of amusement or assembly; and
2222 (5) establishment of curfews[;
2323 [(6) control of the sale, transportation, and use of
2424 alcoholic beverages; and
2525 [(7) control of the storage, use, and transportation
2626 of explosives or flammable materials considered dangerous to public
2727 safety, other than explosives or flammable materials that are
2828 components of firearm ammunition].
2929 SECTION 2. Section 418.019, Government Code, is repealed.
3030 SECTION 3. This Act takes effect September 1, 2023.
