9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter A, Chapter 232, Election Code, is | |
11 | 11 | amended by adding Section 232.0035 to read as follows: | |
12 | 12 | Sec. 232.0035. COUNTY CLERK AS NECESSARY PARTY IN CERTAIN | |
13 | 13 | CONTESTS. (a) In any contested election in which a contestant | |
14 | 14 | alleges that an election official engaged in conduct described by | |
15 | 15 | Section 221.003(a)(2), the county clerk is a necessary party to the | |
16 | 16 | proceedings. | |
17 | 17 | (b) A county clerk may not recover fees or costs incurred as | |
18 | 18 | a party to an election contest as required under Subsection (a). | |
19 | 19 | SECTION 2. This Act takes effect September 1, 2023. |
