| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 601.001, Local Government Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Sec. 601.001. PARKING ON PRIVATE PROPERTY. (a) A |
|---|
| 13 | 13 | | municipality by ordinance may regulate the parking of motor |
|---|
| 14 | 14 | | vehicles on private property and may enforce the ordinance in the |
|---|
| 15 | 15 | | same manner that it enforces ordinances regulating parking in |
|---|
| 16 | 16 | | public no-parking zones, including the impoundment of offending |
|---|
| 17 | 17 | | vehicles. |

| 18 | 18 | | (b) As provided by Chapter 682, Transportation Code, a |
|---|
| 19 | 19 | | municipality with a population of 1.9 million or more may: |
|---|
| 20 | 20 | | (1) declare the violation of a municipal ordinance |
|---|
| 21 | 21 | | relating to the parking of an unattended motor vehicle in the front |
|---|
| 22 | 22 | | or side yard of a single-family residence in a residential area to |
|---|
| 23 | 23 | | be a civil offense; and |
|---|
| 24 | 24 | | (2) by ordinance establish an administrative |
|---|
| 25 | 25 | | adjudication hearing procedure under which a civil fine may be |
|---|
| 26 | 26 | | imposed. |
|---|
| 27 | 27 | | SECTION 2. This Act takes effect September 1, 2023. |
