66 AN ACT
77 relating to the civil prosecution of offenses involving certain
88 municipal parking ordinances; authorizing a civil fine.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 601.001, Local Government Code, is
1111 amended to read as follows:
1212 Sec. 601.001. PARKING ON PRIVATE PROPERTY. (a) A
1313 municipality by ordinance may regulate the parking of motor
1414 vehicles on private property and may enforce the ordinance in the
1515 same manner that it enforces ordinances regulating parking in
1616 public no-parking zones, including the impoundment of offending
1717 vehicles.
1818 (b) As provided by Chapter 682, Transportation Code, a
1919 municipality with a population of 1.9 million or more may:
2020 (1) declare the violation of a municipal ordinance
2121 relating to the parking of an unattended motor vehicle in the front
2222 or side yard of a single-family residence in a residential area to
2323 be a civil offense; and
2424 (2) by ordinance establish an administrative
2525 adjudication hearing procedure under which a civil fine may be
2626 imposed.
2727 SECTION 2. This Act takes effect September 1, 2023.
