| 7 | 7 | | relating to certain motor vehicle safety inspection fees. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 548.501, Transportation Code, is amended |
|---|
| 10 | 10 | | by amending Subsection (a) and adding Subsection (a-1) to read as |
|---|
| 11 | 11 | | follows: |
|---|
| 12 | 12 | | (a) Except as provided by Sections 548.503 and 548.504, the |
|---|
| 13 | 13 | | fee for inspection of a motor vehicle other than a moped is an |
|---|
| 14 | 14 | | amount set by the department as prescribed by Subsection (a-1) |
|---|
| 15 | 15 | | [$12.50]. The fee for inspection of a moped is $5.75. |
|---|
| 16 | 16 | | (a-1) On or before September 1 of each year, the department |
|---|
| 17 | 17 | | by rule shall set the fee for inspection of a motor vehicle other |
|---|
| 18 | 18 | | than a moped under this section. The fee must be calculated so that |
|---|
| 19 | 19 | | an inspection station may retain for each inspection an amount |
|---|
| 20 | 20 | | equal to one hour's pay at the minimum hourly wage prescribed by the |
|---|
| 21 | 21 | | General Appropriations Act for salary group A6 of the position |
|---|
| 22 | 22 | | classification salary schedule. |
|---|
| 23 | 23 | | SECTION 2. (a) The Department of Public Safety shall adopt |
|---|
| 24 | 24 | | rules establishing the fee for the inspection of a motor vehicle |
|---|
| 25 | 25 | | other than a moped under Section 548.501, Transportation Code, as |
|---|
| 26 | 26 | | amended by this Act, as soon as practicable after the effective date |
|---|
| 27 | 27 | | of this Act. |
|---|
| 28 | 28 | | (b) Section 548.501, Transportation Code, as amended by |
|---|
| 29 | 29 | | this Act, applies only to an inspection of a motor vehicle performed |
|---|
| 30 | 30 | | on or after the effective date of the rules described by Subsection |
|---|
| 31 | 31 | | (a) of this section. An inspection performed before that date is |
|---|
| 32 | 32 | | governed by the law in effect immediately before the effective date |
|---|
| 33 | 33 | | of this Act, and the former law is continued in effect for that |
|---|
| 34 | 34 | | purpose. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect September 1, 2023. |
