66 AN ACT
77 relating to the administration of the financial responsibility
88 verification program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 502.357(b), (c), and (d),
1111 Transportation Code, are amended to read as follows:
1212 (b) Fees collected under this section shall be deposited to
1313 the credit of the state highway fund except that the comptroller
1414 shall provide for a portion of the fees to be deposited first to the
1515 credit of a special fund in the state treasury outside the general
1616 revenue fund to be known as the TexasSure Fund in a total amount
1717 that is necessary to cover the total amount appropriated to the
1818 office of the attorney general [Texas Department of Insurance] from
1919 that fund and for the remaining fees to be deposited to the state
2020 highway fund. Subject to appropriations, the money deposited to
2121 the credit of the state highway fund under this section may be used
2222 by the Department of Public Safety to:
2323 (1) support the Department of Public Safety's
2424 reengineering of the driver's license system to provide for the
2525 issuance by the Department of Public Safety of a driver's license or
2626 personal identification certificate, to include use of image
2727 comparison technology; and
2828 (2) make lease payments to the master lease purchase
2929 program for the financing of the driver's license reengineering
3030 project.
3131 (c) Subject to appropriation, fees collected under this
3232 section may be used by the Department of Public Safety, the office
3333 of the attorney general [Texas Department of Insurance], the
3434 Department of Information Resources, and the department to carry
3535 out Subchapter N, Chapter 601.
3636 (d) The Department of Public Safety, the office of the
3737 attorney general [Texas Department of Insurance], the Department of
3838 Information Resources, and the department shall jointly adopt rules
3939 and develop forms necessary to administer this section.
4040 SECTION 2. Section 601.451, Transportation Code, is amended
4141 to read as follows:
4242 Sec. 601.451. DEFINITION. In this subchapter,
4343 "implementing agencies" means:
4444 (1) the department;
4545 (2) the Texas Department of Motor Vehicles;
4646 (3) the Texas Department of Insurance; [and]
4747 (4) the Department of Information Resources; and
4848 (5) the office of the attorney general.
4949 SECTION 3. Section 601.452(a), Transportation Code, is
5050 amended to read as follows:
5151 (a) The office of the attorney general [Texas Department of
5252 Insurance] in consultation with the other implementing agencies
5353 shall establish a program for verification of whether owners of
5454 motor vehicles have established financial responsibility. The
5555 program established must be:
5656 (1) the program most likely to:
5757 (A) reduce the number of uninsured motorists in
5858 this state;
5959 (B) operate reliably;
6060 (C) be cost-effective;
6161 (D) sufficiently protect the privacy of the motor
6262 vehicle owners;
6363 (E) sufficiently safeguard the security and
6464 integrity of information provided by insurance companies;
6565 (F) identify and employ a method of compliance
6666 that improves public convenience; and
6767 (G) provide information that is accurate and
6868 current; and
6969 (2) capable of being audited by an independent
7070 auditor.
7171 SECTION 4. Section 601.453(a), Transportation Code, is
7272 amended to read as follows:
7373 (a) The office of the attorney general [Texas Department of
7474 Insurance] in consultation with the other implementing agencies,
7575 under a competitive bidding procedure, shall select an agent to
7676 develop, implement, operate, and maintain the program.
7777 SECTION 5. Not later than January 1, 2024, the following are
7878 transferred from the Texas Department of Insurance to the office of
7979 the attorney general:
8080 (1) the powers, duties, functions, and activities of
8181 the Texas Department of Insurance relating to the establishment and
8282 operation of the financial responsibility verification program
8383 under Subchapter N, Chapter 601, Transportation Code;
8484 (2) any obligations and contracts of the Texas
8585 Department of Insurance that are directly related to implementing a
8686 power, duty, function, or activity transferred under this section;
8787 and
8888 (3) all property and records in the custody of the
8989 Texas Department of Insurance that are related to a power, duty,
9090 function, or activity transferred under this section and all funds
9191 appropriated by the legislature for that power, duty, function, or
9292 activity.
9393 SECTION 6. Not later than the 60th day after the effective
9494 date of this Act, the Texas Department of Insurance and the office
9595 of the attorney general shall enter into a memorandum of
9696 understanding that establishes a plan for the identification and
9797 transfer of the records, property, and unspent appropriations of
9898 the Texas Department of Insurance that are used for purposes of the
9999 department's powers and duties directly related to the
100100 establishment and operation of the financial responsibility
101101 verification program under Subchapter N, Chapter 601,
102102 Transportation Code.
103103 SECTION 7. This Act takes effect September 1, 2023.
