66 AN ACT
77 relating to mental health first aid training for certain school
88 district employees and volunteers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter Z, Chapter 22, Education Code, is
1111 amended by adding Section 22.904 to read as follows:
1212 Sec. 22.904. MENTAL HEALTH FIRST AID TRAINING. A school
1313 district shall require each district employee or volunteer who
1414 regularly interacts with students enrolled at the district,
1515 including an educator, school bus driver, custodian, or cafeteria
1616 worker, to complete an evidence-based mental health first aid
1717 training program designed to provide instruction to participants
1818 regarding the recognition and support of children and youth who
1919 experience a mental health or substance use issue.
2020 SECTION 2. Section 1001.201, Health and Safety Code, is
2121 amended by amending Subdivision (4) and adding Subdivision (4-a) to
2222 read as follows:
2323 (4) "School district employee" means a person employed
2424 by a school district who regularly interacts with students through
2525 the course of the person's duties, including an educator, a
2626 secretary, a school bus driver, a custodian, or a cafeteria worker.
2727 (4-a) "School district volunteer" means a person who
2828 volunteers at a school district and regularly interacts with
2929 students at the district while performing duties as a volunteer.
3030 SECTION 3. The heading to Section 1001.203, Health and
3131 Safety Code, is amended to read as follows:
3232 Sec. 1001.203. GRANTS FOR TRAINING CERTAIN UNIVERSITY
3333 EMPLOYEES, SCHOOL DISTRICT EMPLOYEES, SCHOOL DISTRICT VOLUNTEERS,
3434 AND SCHOOL RESOURCE OFFICERS IN MENTAL HEALTH FIRST AID.
3535 SECTION 4. Sections 1001.203(a), (c), and (e), Health and
3636 Safety Code, are amended to read as follows:
3737 (a) To the extent funds are appropriated to the department
3838 for that purpose, the department shall make grants to local mental
3939 health authorities to provide an approved mental health first aid
4040 training program, administered by mental health first aid trainers,
4141 at no cost to university employees, school district employees,
4242 school district volunteers, and school resource officers.
4343 (c) The department shall grant $100 to a local mental health
4444 authority for each university employee, school district employee,
4545 school district volunteer, or school resource officer who
4646 successfully completes a mental health first aid training program
4747 provided by the authority under this section.
4848 (e) A local mental health authority may contract with a
4949 regional education service center to provide a mental health first
5050 aid training program to university employees, school district
5151 employees, school district volunteers, and school resource
5252 officers under this section.
5353 SECTION 5. The heading to Section 1001.2031, Health and
5454 Safety Code, is amended to read as follows:
5555 Sec. 1001.2031. SUPPLEMENTAL GRANTS FOR TRAINING CERTAIN
5656 UNIVERSITY EMPLOYEES, SCHOOL DISTRICT EMPLOYEES, SCHOOL DISTRICT
5757 VOLUNTEERS, AND SCHOOL RESOURCE OFFICERS IN MENTAL HEALTH FIRST
5858 AID.
5959 SECTION 6. Sections 1001.205(a) and (b), Health and Safety
6060 Code, are amended to read as follows:
6161 (a) Not later than September 30 of each year, a local mental
6262 health authority shall provide to the department the number of:
6363 (1) employees and contractors of the authority who
6464 were trained as mental health first aid trainers under Section
6565 1001.202 during the preceding fiscal year, the number of trainers
6666 who left the program for any reason during the preceding fiscal
6767 year, and the number of active trainers;
6868 (2) university employees, school district employees,
6969 school district volunteers, and school resource officers who
7070 completed a mental health first aid training program offered by the
7171 authority under Section 1001.203 during the preceding fiscal year
7272 categorized by local mental health authority region, university or
7373 school district, as applicable, and category of personnel;
7474 (3) individuals who are not university employees,
7575 school district employees, school district volunteers, or school
7676 resource officers who completed a mental health first aid training
7777 program offered by the authority during the preceding fiscal year;
7878 and
7979 (4) veterans and immediate family members of veterans
8080 who completed the veterans module of a mental health first aid
8181 training program offered by the authority during the preceding
8282 fiscal year.
8383 (b) Not later than December 1 of each year, the department
8484 shall compile the information submitted by local mental health
8585 authorities as required by Subsection (a) and submit a report to the
8686 legislature containing:
8787 (1) the number of authority employees and contractors
8888 trained as mental health first aid trainers during the preceding
8989 fiscal year, the number of trainers who left the program for any
9090 reason during the preceding fiscal year, and the number of active
9191 trainers;
9292 (2) the number of university employees, school
9393 district employees, school district volunteers, and school
9494 resource officers who completed a mental health first aid training
9595 program provided by an authority during the preceding fiscal year
9696 categorized by local mental health authority region, university or
9797 school district, as applicable, and category of personnel;
9898 (3) the number of individuals who are not university
9999 employees, school district employees, school district volunteers,
100100 or school resource officers who completed a mental health first aid
101101 training program provided by an authority during the preceding
102102 fiscal year;
103103 (4) veterans and immediate family members of veterans
104104 who completed the veterans module of a mental health first aid
105105 training program provided by an authority during the preceding
106106 fiscal year; and
107107 (5) a detailed accounting of expenditures of money
108108 appropriated for the purpose of implementing this subchapter.
109109 SECTION 7. Not later than September 1, 2024, each school
110110 district shall ensure that each district employee or volunteer
111111 described by Section 22.904, Education Code, as added by this Act,
112112 has completed an evidence-based mental health first aid training
113113 program as required by that section.
114114 SECTION 8. This Act takes effect September 1, 2023.
