55 relating to authorizing certain counties to impose a hotel
66 occupancy tax and the use of revenue from that tax.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 352.002, Tax Code, is amended by adding
99 Subsection (v) to read as follows:
1010 (v) The commissioners court of a county with a population of
1111 more than 650,000 that is adjacent to two counties, each having a
1212 population of more than 1.8 million, may impose a tax as provided by
1313 Subsection (a). A tax imposed under this subsection does not apply
1414 to a hotel that is located on contiguous property in more than one
1515 county.
1616 SECTION 2. Section 352.003, Tax Code, is amended by adding
1717 Subsection (bb) to read as follows:
1818 (bb) The tax rate in a county authorized to impose the tax
1919 under Section 352.002(v) may not exceed two percent of the price
2020 paid for a room in a hotel.
2121 SECTION 3. Subchapter B, Chapter 352, Tax Code, is amended
2222 by adding Section 352.115 to read as follows:
2323 Sec. 352.115. USE OF REVENUE: CERTAIN COUNTIES ADJACENT TO
2424 POPULOUS COUNTIES. In addition to the purposes authorized by this
2525 chapter, the revenue from a tax imposed under this chapter by a
2626 county authorized to impose the tax under Section 352.002(v) may be
2727 used for the purposes described by Section 352.112.
2828 SECTION 4. This Act takes effect September 1, 2023.
