55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to local school health advisory councils and health
88 education provided by public schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 28.004(c), Education Code, is amended to
1111 read as follows:
1212 (c) The local school health advisory council's duties
1313 include recommending:
1414 (1) the number of hours of instruction to be provided
1515 in:
1616 (A) health education in kindergarten through
1717 grade eight; and
1818 (B) if the school district requires health
1919 education for high school graduation, health education, including
2020 physical health education and mental health education, in grades 9
2121 through 12;
2222 (2) policies, procedures, strategies, and curriculum
2323 appropriate for specific grade levels designed to prevent physical
2424 health concerns, including obesity, cardiovascular disease, Type 2
2525 diabetes, and mental health concerns, including suicide, through
2626 coordination of:
2727 (A) health education, which must address
2828 physical health concerns and mental health concerns to ensure the
2929 integration of physical health education and mental health
3030 education;
3131 (B) physical education and physical activity;
3232 (C) nutrition services;
3333 (D) parental involvement;
3434 (E) instruction on substance abuse prevention;
3535 (F) school health services, including mental
3636 health services;
3737 (G) a comprehensive school counseling program
3838 under Section 33.005;
3939 (H) a safe and healthy school environment; [and]
4040 (I) school employee wellness; and
4141 (J) social emotional learning and character
4242 trait curriculum;
4343 (3) appropriate grade levels and methods of
4444 instruction for human sexuality instruction;
4545 (4) strategies for integrating the curriculum
4646 components specified by Subdivision (2) with the following elements
4747 in a coordinated school health program for the district:
4848 (A) school health services, including physical
4949 health services and mental health services, if provided at a campus
5050 by the district or by a third party under a contract with the
5151 district;
5252 (B) a comprehensive school counseling program
5353 under Section 33.005;
5454 (C) a safe and healthy school environment; and
5555 (D) school employee wellness;
5656 (5) if feasible, joint use agreements or strategies
5757 for collaboration between the school district and community
5858 organizations or agencies;
5959 (6) strategies to increase parental awareness
6060 regarding:
6161 (A) risky behaviors and early warning signs of
6262 suicide risks and behavioral health concerns, including mental
6363 health disorders and substance use disorders; and
6464 (B) available community programs and services
6565 that address risky behaviors, suicide risks, and behavioral health
6666 concerns;
6767 (7) appropriate grade levels and curriculum for
6868 instruction regarding opioid addiction and abuse and methods of
6969 administering an opioid antagonist, as defined by Section 483.101,
7070 Health and Safety Code; and
7171 (8) appropriate grade levels and curriculum for
7272 instruction regarding child abuse, family violence, dating
7373 violence, and sex trafficking, including likely warning signs that
7474 a child may be at risk for sex trafficking, provided that the local
7575 school health advisory council's recommendations under this
7676 subdivision do not conflict with the essential knowledge and skills
7777 developed by the State Board of Education under this subchapter.
7878 SECTION 2. This Act takes effect September 1, 2023.
