| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 48.005(a), Education Code, is amended to |
|---|
| 9 | 9 | | read as follows: |
|---|
| 10 | 10 | | (a) In this chapter, average daily attendance is: |
|---|
| 11 | 11 | | (1) the quotient of the sum of attendance for each day |
|---|
| 12 | 12 | | of the minimum number of days of instruction as described under |
|---|
| 13 | 13 | | Section 25.081(a) divided by the minimum number of days of |
|---|
| 14 | 14 | | instruction; |
|---|
| 15 | 15 | | (2) for a district that operates under a flexible year |
|---|
| 16 | 16 | | program under Section 29.0821, the quotient of the sum of |
|---|
| 17 | 17 | | attendance for each actual day of instruction as permitted by |
|---|
| 18 | 18 | | Section 29.0821(b)(1) divided by the number of actual days of |
|---|
| 19 | 19 | | instruction as permitted by Section 29.0821(b)(1); or |
|---|
| 20 | 20 | | (3) for a district that operates under a flexible |
|---|
| 21 | 21 | | school day program under Section 29.0822, the average daily |
|---|
| 22 | 22 | | attendance as calculated by the commissioner in accordance with |
|---|
| 23 | 23 | | Sections 29.0822(d) and (d-1); or |
|---|
| 24 | 24 | | (4) for a district that operates a half-day program |
|---|
| 25 | 25 | | [or a full-day program under Section 29.153(c)], one-half of the |
|---|
| 26 | 26 | | average daily attendance calculated under Subdivision (1). |
|---|
| 27 | 27 | | SECTION 2. This Act takes effect September 1, 2023. |
