8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 29.908, Education Code, is amended by |
---|
10 | 10 | | amending Subsection (b) and adding Subsections (b-3) and (h) to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | (b) The program must: |
---|
13 | 13 | | (1) provide for a course of study that enables a |
---|
14 | 14 | | participating student to combine high school courses and |
---|
15 | 15 | | college-level courses during grade levels 9 through 12; |
---|
16 | 16 | | (2) allow a participating student to complete high |
---|
17 | 17 | | school and, on or before the fifth anniversary of the date of the |
---|
18 | 18 | | student's first day of high school, receive a high school diploma |
---|
19 | 19 | | and either: |
---|
20 | 20 | | (A) an associate degree; or |
---|
21 | 21 | | (B) at least 60 semester credit hours toward a |
---|
22 | 22 | | baccalaureate degree; |
---|
23 | 23 | | (3) include articulation agreements with colleges, |
---|
24 | 24 | | universities, and technical schools in this state to provide a |
---|
25 | 25 | | participating student access to postsecondary educational and |
---|
26 | 26 | | training opportunities at a college, university, or technical |
---|
27 | 27 | | school; [and] |
---|
28 | 28 | | (4) provide a participating student flexibility in |
---|
29 | 29 | | class scheduling and academic mentoring; |
---|
30 | 30 | | (5) allow a student to participate in the program |
---|
31 | 31 | | without receiving a scale score that indicates satisfactory |
---|
32 | 32 | | performance on a college readiness assessment instrument |
---|
33 | 33 | | designated by the Texas Higher Education Coordinating Board under |
---|
34 | 34 | | Section 51.334; and |
---|
35 | 35 | | (6) provide flexibility for school districts' and |
---|
36 | 36 | | open-enrollment charter schools' committees described by |
---|
37 | 37 | | Subsection (b-3) to have discretion over the eligibility of a |
---|
38 | 38 | | student to participate in the program, including by allowing the |
---|
39 | 39 | | student to be exempt from an assessment requirement related to the |
---|
40 | 40 | | program. |
---|
41 | 41 | | (b-3) A student's eligibility to participate in the program |
---|
42 | 42 | | shall be determined by, as applicable: |
---|
43 | 43 | | (1) the student's admission, review, and dismissal |
---|
44 | 44 | | committee; |
---|
45 | 45 | | (2) a committee established for the student under |
---|
46 | 46 | | Section 504, Rehabilitation Act of 1973 (29 U.S.C. Section 794); or |
---|
47 | 47 | | (3) if Subdivisions (1) and (2) are not applicable to |
---|
48 | 48 | | the student, a committee composed of the student, the student's |
---|
49 | 49 | | parent or person standing in parental relation to the student, a |
---|
50 | 50 | | school administrator, and a teacher. |
---|
51 | 51 | | (h) A high school designated as an early college high school |
---|
52 | 52 | | shall report through the Public Education Information System |
---|
53 | 53 | | (PEIMS) the number of students who were dismissed before graduating |
---|
54 | 54 | | from the high school in conjunction with the student's performance |
---|
55 | 55 | | on applicable Texas Success Initiative (TSI) college readiness |
---|
56 | 56 | | benchmarks prescribed by the Texas Higher Education Coordinating |
---|
57 | 57 | | Board under Section 51.334 on an assessment instrument designated |
---|
58 | 58 | | by the coordinating board under that section, disaggregated by |
---|
59 | 59 | | students' race, ethnicity, sex, grade level, and status as: |
---|
60 | 60 | | (1) students enrolled in a special education program; |
---|
61 | 61 | | (2) educationally disadvantaged students; |
---|
62 | 62 | | (3) emergent bilingual students, as defined by Section |
---|
63 | 63 | | 29.052; and |
---|
64 | 64 | | (4) students experiencing homelessness. |
---|
65 | 65 | | SECTION 2. This Act takes effect September 1, 2023. |
