55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to requirements for the early college education program.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 29.908, Education Code, is amended by
1010 amending Subsection (b) and adding Subsections (b-3) and (h) to
1111 read as follows:
1212 (b) The program must:
1313 (1) provide for a course of study that enables a
1414 participating student to combine high school courses and
1515 college-level courses during grade levels 9 through 12;
1616 (2) allow a participating student to complete high
1717 school and, on or before the fifth anniversary of the date of the
1818 student's first day of high school, receive a high school diploma
1919 and either:
2020 (A) an associate degree; or
2121 (B) at least 60 semester credit hours toward a
2222 baccalaureate degree;
2323 (3) include articulation agreements with colleges,
2424 universities, and technical schools in this state to provide a
2525 participating student access to postsecondary educational and
2626 training opportunities at a college, university, or technical
2727 school; [and]
2828 (4) provide a participating student flexibility in
2929 class scheduling and academic mentoring;
3030 (5) allow a student to participate in the program
3131 without receiving a scale score that indicates satisfactory
3232 performance on a college readiness assessment instrument
3333 designated by the Texas Higher Education Coordinating Board under
3434 Section 51.334; and
3535 (6) provide flexibility for school districts' and
3636 open-enrollment charter schools' committees described by
3737 Subsection (b-3) to have discretion over the eligibility of a
3838 student to participate in the program, including by allowing the
3939 student to be exempt from an assessment requirement related to the
4040 program.
4141 (b-3) A student's eligibility to participate in the program
4242 shall be determined by, as applicable:
4343 (1) the student's admission, review, and dismissal
4444 committee;
4545 (2) a committee established for the student under
4646 Section 504, Rehabilitation Act of 1973 (29 U.S.C. Section 794); or
4747 (3) if Subdivisions (1) and (2) are not applicable to
4848 the student, a committee composed of the student, the student's
4949 parent or person standing in parental relation to the student, a
5050 school administrator, and a teacher.
5151 (h) A high school designated as an early college high school
5252 shall report through the Public Education Information System
5353 (PEIMS) the number of students who were dismissed before graduating
5454 from the high school in conjunction with the student's performance
5555 on applicable Texas Success Initiative (TSI) college readiness
5656 benchmarks prescribed by the Texas Higher Education Coordinating
5757 Board under Section 51.334 on an assessment instrument designated
5858 by the coordinating board under that section, disaggregated by
5959 students' race, ethnicity, sex, grade level, and status as:
6060 (1) students enrolled in a special education program;
6161 (2) educationally disadvantaged students;
6262 (3) emergent bilingual students, as defined by Section
6363 29.052; and
6464 (4) students experiencing homelessness.
6565 SECTION 2. This Act takes effect September 1, 2023.
