| 7 | 7 | | relating to the eligibility for certain occupational licenses based |

| 8 | 8 | | on an arrest or conviction for certain offenses involving a |
|---|
| 9 | 9 | | controlled substance. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 802.107, Occupations Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (d) to read as follows: |
|---|
| 13 | 13 | | (d) Notwithstanding Sections 51.356 and 51.4012 and Chapter |
|---|
| 14 | 14 | | 53, the department may not deny issuance of a license to, refuse to |
|---|
| 15 | 15 | | renew the license of, or revoke or suspend a license held by a |
|---|
| 16 | 16 | | person based on the person's arrest or conviction for an offense |
|---|
| 17 | 17 | | involving the possession, manufacture, or delivery of a controlled |
|---|
| 18 | 18 | | substance. |
|---|
| 19 | 19 | | SECTION 2. Section 1603.401, Occupations Code, is amended |
|---|
| 20 | 20 | | to read as follows: |
|---|
| 21 | 21 | | Sec. 1603.401. DENIAL, SUSPENSION, OR REVOCATION. (a) The |
|---|
| 22 | 22 | | department may deny an application for issuance or renewal of, or |
|---|
| 23 | 23 | | may suspend or revoke, a license or permit if the applicant or |
|---|
| 24 | 24 | | person holding the license or permit: |
|---|
| 25 | 25 | | (1) engages in gross malpractice; |
|---|
| 26 | 26 | | (2) knowingly continues to practice while having an |
|---|
| 27 | 27 | | infectious or contagious disease; |
|---|
| 28 | 28 | | (3) knowingly makes a false or deceptive statement in |
|---|
| 29 | 29 | | advertising; |
|---|
| 30 | 30 | | (4) advertises, practices, or attempts to practice |
|---|
| 31 | 31 | | under another person's name or trade name; |
|---|
| 32 | 32 | | (5) engages in fraud or deceit in obtaining a license |
|---|
| 33 | 33 | | or permit; or |
|---|
| 34 | 34 | | (6) engages in an act that violates this chapter or |
|---|
| 35 | 35 | | Chapter 51 or a rule or order adopted or issued under this chapter |
|---|
| 36 | 36 | | or Chapter 51. |
|---|
| 37 | 37 | | (b) Notwithstanding Sections 51.356 and 51.4012 and Chapter |
|---|
| 38 | 38 | | 53, the department may not deny an application for issuance or |
|---|
| 39 | 39 | | renewal of, or suspend or revoke, a license or permit based on the |
|---|
| 40 | 40 | | arrest or conviction of the applicant or license or permit holder |
|---|
| 41 | 41 | | for an offense involving the possession, manufacture, or delivery |
|---|
| 42 | 42 | | of a controlled substance. |
|---|
| 43 | 43 | | SECTION 3. This Act takes effect September 1, 2023. |
