99 relating to standards for certain electric vehicle charging
1010 stations.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle A, Title 14, Occupations Code, is
1313 amended by adding Chapter 2311 to read as follows:
1414 CHAPTER 2311. ELECTRIC VEHICLE CHARGING STATIONS
1515 Sec. 2311.001. ELECTRIC VEHICLE CHARGING STATION
1616 STANDARDS. (a) This section applies only to an electric vehicle
1717 charging station in this state that is made available to the public
1818 and not intended primarily for private use.
1919 (b) The Texas Department of Licensing and Regulation, in
2020 consultation with the Texas Department of Transportation, shall
2121 adopt standards for electric vehicle charging stations that require
2222 the charging stations to be equipped with a standard electric
2323 vehicle charging connector or plug type that is widely compatible
2424 with as many electric vehicles as practicable.
2525 SECTION 2. (a) Not later than December 1, 2024, the Texas
2626 Department of Licensing and Regulation shall adopt the standards
2727 required by Section 2311.001, Occupations Code, as added by this
2828 Act.
2929 (b) An electric vehicle charging station installed in this
3030 state must be operated in compliance with the standards adopted
3131 under Chapter 2311, Occupations Code, as added by this Act, not
3232 later than January 1, 2030.
3333 SECTION 3. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2023.
