| 8 | 8 | | reimbursement of appropriated money from the Texas Racing |

| 9 | 9 | | Commission fund. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 2023.053(e), Occupations Code, is |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | (e) Any amount of general revenue appropriated for the |
|---|
| 14 | 14 | | administration and enforcement of this subtitle in excess of the |
|---|
| 15 | 15 | | cumulative amount deposited in the Texas Racing Commission fund |
|---|
| 16 | 16 | | shall be reimbursed from the Texas Racing Commission fund [not |
|---|
| 17 | 17 | | later than the first anniversary of the date the general revenue |
|---|
| 18 | 18 | | funds are appropriated, with 6.75 percent interest. All payments |
|---|
| 19 | 19 | | made under this subsection are first attributable to interest |
|---|
| 20 | 20 | | accumulated under this subsection]. |
|---|
| 21 | 21 | | SECTION 2. Section 2023.053(c), Occupations Code, is |
|---|
| 22 | 22 | | repealed. |
|---|
| 23 | 23 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 27 | | Act takes effect September 1, 2023. |
