| 7 | 7 | | relating to the delegation to a pharmacy technician of a |
|---|
| 8 | 8 | | pharmacist's authority to administer an immunization or vaccine. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Section 554.004(a), Occupations Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (a) The board shall specify conditions under which a |
|---|
| 13 | 13 | | pharmacist may administer medication, including an immunization |
|---|
| 14 | 14 | | and vaccination. The conditions must ensure that: |
|---|
| 15 | 15 | | (1) a licensed health care provider authorized to |
|---|
| 16 | 16 | | administer the medication is not reasonably available to administer |
|---|
| 17 | 17 | | the medication; |
|---|
| 18 | 18 | | (2) failure to administer the medication, other than |
|---|
| 19 | 19 | | an immunization or vaccination, might result in a significant delay |
|---|
| 20 | 20 | | or interruption of a critical phase of drug therapy; |
|---|
| 21 | 21 | | (3) the pharmacist possesses the necessary skill, |
|---|
| 22 | 22 | | education, and certification as specified by the board to |
|---|
| 23 | 23 | | administer the medication; |
|---|
| 24 | 24 | | (4) within a reasonable time after administering |
|---|
| 25 | 25 | | medication, the pharmacist notifies the licensed health care |
|---|
| 26 | 26 | | provider responsible for the patient's care that the medication was |
|---|
| 27 | 27 | | administered; |
|---|
| 28 | 28 | | (5) the pharmacist may not administer medication to a |
|---|
| 29 | 29 | | patient at the patient's residence, except at a licensed nursing |
|---|
| 30 | 30 | | home or hospital; |
|---|
| 31 | 31 | | (6) the pharmacist administers an immunization or |
|---|
| 32 | 32 | | vaccination under a physician's written protocol and meets the |
|---|
| 33 | 33 | | standards established by the board; and |
|---|
| 34 | 34 | | (7) the authority of a pharmacist to administer an |
|---|
| 35 | 35 | | immunization or vaccination [medication] may [not] be delegated to |
|---|
| 36 | 36 | | a registered pharmacy technician. |
|---|
| 37 | 37 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 38 | 38 | | of this Act, the Texas State Board of Pharmacy shall adopt rules |
|---|
| 39 | 39 | | necessary to implement Section 554.004(a), Occupations Code, as |
|---|
| 40 | 40 | | amended by this Act. |

| 41 | 41 | | SECTION 3. This Act takes effect September 1, 2023. |
