55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the establishment of the Texas Pay Equity Task Force.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. (a) In this section, "task force" means the Texas
1010 Pay Equity Task Force.
1111 (b) The Texas Pay Equity Task Force is established to assess
1212 whether a disparity exists on the basis of gender, disability, or
1313 race in compensation paid to employees of state agencies, counties,
1414 and municipalities.
1515 (c) The task force is composed of nine members appointed as
1616 follows:
1717 (1) two representatives of state agencies and one
1818 representative of a nonprofit organization engaged in gender,
1919 disability, or race pay equity issues, appointed by the governor;
2020 (2) one representative of a county, one representative
2121 of a municipality, and one representative of a nonprofit
2222 organization engaged in gender, disability, or race pay equity
2323 issues, appointed by the lieutenant governor; and
2424 (3) one representative of a county, one representative
2525 of a municipality, and one representative of a nonprofit
2626 organization engaged in gender, disability, or race pay equity
2727 issues, appointed by the speaker of the house of representatives.
2828 (d) A task force member is not entitled to compensation for
2929 service on the task force but is entitled to reimbursement for
3030 actual and necessary expenses incurred in performing task force
3131 duties. The task force may accept gifts, grants, and donations to
3232 pay for those expenses.
3333 (e) The members of the task force shall elect a presiding
3434 officer from among the membership.
3535 (f) The task force shall meet at least quarterly at the call
3636 of the presiding officer.
3737 (g) Notwithstanding Chapter 551, Government Code, or any
3838 other law, the task force may meet by telephone conference call,
3939 videoconference, or other similar telecommunication method. A
4040 meeting held by telephone conference call, videoconference, or
4141 other similar telecommunication method is subject to the
4242 requirements of Sections 551.125(c), (d), (e), and (f), Government
4343 Code.
4444 (h) The task force shall conduct a study to determine
4545 whether a disparity exists on the basis of gender, disability, or
4646 race in compensation paid to employees of state agencies, counties,
4747 and municipalities. The task force may request payroll information,
4848 including the gender, disability status, and race of each employee,
4949 from a state agency, county, or municipality, and the state agency,
5050 county, or municipality shall comply with the request.
5151 (i) If the task force determines that a pay disparity
5252 exists, the task force shall develop recommendations to eliminate
5353 the disparity.
5454 (j) The task force shall develop and submit a written report
5555 on the study and recommendations developed by the task force to the
5656 governor, the lieutenant governor, the speaker of the house of
5757 representatives, and each member of the legislature not later than
5858 November 1, 2024.
5959 (k) The task force is abolished and this Act expires June 1,
6060 2025.
6161 SECTION 2. This Act takes effect immediately if it receives
6262 a vote of two-thirds of all the members elected to each house, as
6363 provided by Section 39, Article III, Texas Constitution. If this
6464 Act does not receive the vote necessary for immediate effect, this
6565 Act takes effect September 1, 2023.
