| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 15.405(f), Water Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | (f) The board shall adopt rules establishing criteria of |
|---|
| 12 | 12 | | eligibility for flood control planning money that considers: |
|---|
| 13 | 13 | | (1) the relative need of the political subdivision for |
|---|
| 14 | 14 | | the money, giving greater importance to a county that: |
|---|
| 15 | 15 | | (A) has a median household income that is not |
|---|
| 16 | 16 | | greater than 85 percent of the median state household income; or |
|---|
| 17 | 17 | | (B) can demonstrate an inability to adequately |
|---|
| 18 | 18 | | address the county's flood control planning needs without the |
|---|
| 19 | 19 | | money; |
|---|
| 20 | 20 | | (2) the legal authority of the political subdivision |
|---|
| 21 | 21 | | to plan for and control flooding; and |
|---|
| 22 | 22 | | (3) the effect of flood control planning by the |
|---|
| 23 | 23 | | political subdivision on overall flood control in the state and |
|---|
| 24 | 24 | | within the area in which the political subdivision is located. |

| 25 | 25 | | SECTION 2. This Act takes effect September 1, 2023. |
