7 | 7 | | relating to the regulation of certain contract carriers and |

8 | 8 | | subcontractors of contract carriers. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. Section 644.054, Transportation Code, is amended |
---|
11 | 11 | | by amending Subsections (a) and (b) and adding Subsection (a-1) to |
---|
12 | 12 | | read as follows: |
---|
13 | 13 | | (a) In this section, "contract carrier" includes a |
---|
14 | 14 | | subcontractor of a contract carrier. |
---|
15 | 15 | | (a-1) This section applies only to a contract carrier that |
---|
16 | 16 | | transports an operating employee of a railroad on a road or highway |
---|
17 | 17 | | of this state in a vehicle designed to carry 15 or fewer passengers. |
---|
18 | 18 | | (b) The department shall adopt rules regulating the |
---|
19 | 19 | | operation of a contract carrier to which this section applies. The |
---|
20 | 20 | | rules must: |
---|
21 | 21 | | (1) prohibit a person from operating a vehicle for |
---|
22 | 22 | | more than 12 hours in a day; |
---|
23 | 23 | | (2) require a person who operates a vehicle for the |
---|
24 | 24 | | number of consecutive hours or days the department determines is |
---|
25 | 25 | | excessive to rest for a period determined by the department; |
---|
26 | 26 | | (3) require a contract carrier to keep a record of all |
---|
27 | 27 | | hours a vehicle subject to regulation under this section is |
---|
28 | 28 | | operated; |
---|
29 | 29 | | (4) require a contract carrier to perform alcohol and |
---|
30 | 30 | | drug testing of vehicle operators on employment, on suspicion of |
---|
31 | 31 | | alcohol or drug abuse, and periodically as determined by the |
---|
32 | 32 | | department; |
---|
33 | 33 | | (5) require a contract carrier, at a minimum, to |
---|
34 | 34 | | maintain commercial automobile liability insurance in the amount of |
---|
35 | 35 | | $3 [$1.5] million for each vehicle; and |
---|
36 | 36 | | (6) be determined by the department to be necessary to |
---|
37 | 37 | | protect the safety of a passenger being transported or the general |
---|
38 | 38 | | public. |
---|
39 | 39 | | SECTION 2. This Act takes effect September 1, 2023. |
