66 AN ACT
77 relating to the regulation of certain contract carriers and
88 subcontractors of contract carriers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 644.054, Transportation Code, is amended
1111 by amending Subsections (a) and (b) and adding Subsection (a-1) to
1212 read as follows:
1313 (a) In this section, "contract carrier" includes a
1414 subcontractor of a contract carrier.
1515 (a-1) This section applies only to a contract carrier that
1616 transports an operating employee of a railroad on a road or highway
1717 of this state in a vehicle designed to carry 15 or fewer passengers.
1818 (b) The department shall adopt rules regulating the
1919 operation of a contract carrier to which this section applies. The
2020 rules must:
2121 (1) prohibit a person from operating a vehicle for
2222 more than 12 hours in a day;
2323 (2) require a person who operates a vehicle for the
2424 number of consecutive hours or days the department determines is
2525 excessive to rest for a period determined by the department;
2626 (3) require a contract carrier to keep a record of all
2727 hours a vehicle subject to regulation under this section is
2828 operated;
2929 (4) require a contract carrier to perform alcohol and
3030 drug testing of vehicle operators on employment, on suspicion of
3131 alcohol or drug abuse, and periodically as determined by the
3232 department;
3333 (5) require a contract carrier, at a minimum, to
3434 maintain commercial automobile liability insurance in the amount of
3535 $3 [$1.5] million for each vehicle; and
3636 (6) be determined by the department to be necessary to
3737 protect the safety of a passenger being transported or the general
3838 public.
3939 SECTION 2. This Act takes effect September 1, 2023.
