44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to design considerations of transportation projects by the
77 Texas Department of Transportation.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 201.615, Transportation Code, is amended
1010 by amending Subsection (a) and adding Subsection (d) to read as
1111 follows:
1212 (a) The department shall consider, in accordance with the
1313 NEPA requirements for studying design alternatives, the following
1414 factors when developing transportation projects that involve the
1515 construction, reconstruction, rehabilitation, or resurfacing of a
1616 highway, other than a maintenance resurfacing project:
1717 (1) the extent to which the project promotes safety;
1818 (2) the durability of the project;
1919 (3) the economy of maintenance of the project;
2020 (4) the impact of the project on:
2121 (A) the natural and artificial environment;
2222 (B) the scenic and aesthetic character of the
2323 area in which the project is located;
2424 (C) preservation efforts; and
2525 (D) each affected local community and its
2626 economy;
2727 (5) the access for other modes of transportation,
2828 including those that promote physically active communities; [and]
2929 (6) except as provided by Subsection (c), the
3030 aesthetic character of the project, including input from each
3131 affected local community;
3232 (7) except as provided by Subsection (d), an
3333 alternative design for the project that has been approved by a vote
3434 of the governing body of a municipality or county that represents an
3535 affected local community; and
3636 (8) the negative impacts to an affected local
3737 community from previous transportation projects.
3838 (d) Subsection (a)(7) does not apply to a transportation
3939 project if the department finds that an alternative design for a
4040 transportation project approved by the governing body of a
4141 municipality or county is frivolous, unreasonable, or intended to
4242 delay a transportation project.
4343 SECTION 2. This Act takes effect September 1, 2023.
