| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Article 42.03, Code of Criminal Procedure, is |
|---|
| 10 | 10 | | amended by adding Section 2-a to read as follows: |
|---|
| 11 | 11 | | Sec. 2-a. In addition to relating the credit given to a |
|---|
| 12 | 12 | | defendant under Section 2, the judge of the court in which the |
|---|
| 13 | 13 | | defendant is convicted may give the defendant credit on the |
|---|
| 14 | 14 | | defendant's sentence for any time the defendant was confined in |
|---|
| 15 | 15 | | jail or prison for another case only, if that confinement occurred |
|---|
| 16 | 16 | | after or before the commission of the offense for which the |
|---|
| 17 | 17 | | defendant is convicted and before the date of the defendant's |
|---|
| 18 | 18 | | sentencing. |

| 19 | 19 | | Sec. 2-b. In addition to the credit given to a defendant |
|---|
| 20 | 20 | | under Section 2, the judge of the court in which the defendant is |
|---|
| 21 | 21 | | convicted may give the defendant combined credit on the defendant's |
|---|
| 22 | 22 | | sentence for any time the defendant was confined in jail or prison |
|---|
| 23 | 23 | | for another case regardless of which plea deal the defendant agrees |
|---|
| 24 | 24 | | to. |
|---|
| 25 | 25 | | SECTION 2. The change in law made by this Act applies to a |
|---|
| 26 | 26 | | defendant who is sentenced for an offense on or after the effective |
|---|
| 27 | 27 | | date of this Act, regardless of whether the offense is committed |
|---|
| 28 | 28 | | before, on, or after the effective date of this Act. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect September 1, 2023. |
