| 7 | 7 | | relating to protections for certain military dependents enrolled in |

| 8 | 8 | | a public school. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter Z, Chapter 25, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 25.906 to read as follows: |
|---|
| 12 | 12 | | Sec. 25.906. PROTECTIONS FOR CERTAIN MILITARY DEPENDENTS. |
|---|
| 13 | 13 | | (a) In this section: |
|---|
| 14 | 14 | | (1) "Compact" means the Interstate Compact on |
|---|
| 15 | 15 | | Educational Opportunity for Military Children executed under |
|---|
| 16 | 16 | | Section 162.002. |
|---|
| 17 | 17 | | (2) "Uniformed services" means: |
|---|
| 18 | 18 | | (A) the United States Army, Navy, Air Force, |
|---|
| 19 | 19 | | Space Force, Marine Corps, or Coast Guard; |
|---|
| 20 | 20 | | (B) the Commissioned Corps of the National |
|---|
| 21 | 21 | | Oceanic and Atmospheric Administration; or |
|---|
| 22 | 22 | | (C) the Commissioned Corps of the United States |
|---|
| 23 | 23 | | Public Health Service. |
|---|
| 24 | 24 | | (b) The provisions of Articles IV, V, VI, and VII of the |
|---|
| 25 | 25 | | compact apply to the following children as if those children were |
|---|
| 26 | 26 | | children described by Article III of the compact: |
|---|
| 27 | 27 | | (1) a child of a veteran of the uniformed services who |
|---|
| 28 | 28 | | was discharged or released through retirement, for a period of four |
|---|
| 29 | 29 | | years after the date of the veteran's retirement, if the veteran |
|---|
| 30 | 30 | | returns to the veteran's home of record on military orders; and |
|---|
| 31 | 31 | | (2) a child of a member of the uniformed services who |
|---|
| 32 | 32 | | dies on active duty or as a result of injuries sustained on active |
|---|
| 33 | 33 | | duty, for a period of four years after the member's death. |
|---|
| 34 | 34 | | (c) Each school district and open-enrollment charter school |
|---|
| 35 | 35 | | that maintains an Internet website shall post on the district's or |
|---|
| 36 | 36 | | school's Internet website an easily accessible link to information |
|---|
| 37 | 37 | | regarding the compact and the additional protections provided by |
|---|
| 38 | 38 | | this section. |
|---|
| 39 | 39 | | SECTION 2. This Act applies beginning with the 2023-2024 |
|---|
| 40 | 40 | | school year. |
|---|
| 41 | 41 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 45 | | Act takes effect September 1, 2023. |
