| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. This Act may be cited as Nancy's Law. |
|---|
| 10 | 10 | | SECTION 2. Section 508.153(e), Government Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (e) In this section: |
|---|
| 13 | 13 | | (1) "Close [, "close] relative of a deceased |
|---|
| 14 | 14 | | victim[,]" means a person who, regardless of whether the victim's |
|---|
| 15 | 15 | | death was related to the offense committed, was: |
|---|
| 16 | 16 | | (A) the spouse of the victim at the time of the |
|---|
| 17 | 17 | | victim's death; |
|---|
| 18 | 18 | | (B) a parent of the deceased victim; |
|---|
| 19 | 19 | | (C) an adult brother, sister, or child of the |
|---|
| 20 | 20 | | deceased victim; or |
|---|
| 21 | 21 | | (D) the nearest relative of the deceased victim |
|---|
| 22 | 22 | | by consanguinity, if the persons described by Paragraphs (A) |
|---|
| 23 | 23 | | through (C) are deceased or are incapacitated due to physical or |
|---|
| 24 | 24 | | mental illness or infirmity. |
|---|
| 25 | 25 | | (2) "Guardian ["guardian] of a victim[,]" and "victim" |
|---|
| 26 | 26 | | have the meanings assigned by Section 508.117. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect September 1, 2023. |
