55 relating to the establishment and administration of the Texas
66 Semiconductor Innovation Consortium.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Chapter 481, Government Code, is amended by
99 adding Subchapter GG to read as follows:
1010 SUBCHAPTER GG. TEXAS SEMICONDUCTOR INNOVATION CONSORTIUM
1111 Sec. 481.651. DEFINITIONS. In this subchapter:
1212 (1) "Consortium" means the Texas Semiconductor
1313 Innovation Consortium.
1414 (2) "Executive committee" means the executive
1515 committee of the consortium.
1616 (3) "Fund" means the Texas Semiconductor Innovation
1717 Fund.
1818 (4) "Institution of higher education" has the meaning
1919 assigned by Section 61.003, Education Code.
2020 Sec. 481.652. ESTABLISHMENT; PURPOSES. (a) The Texas
2121 Semiconductor Innovation Consortium is established as an advisory
2222 panel to the governor and the legislature.
2323 (b) The purposes of the consortium are to:
2424 (1) leverage the expertise and capacity of
2525 institutions of higher education, industry, and nonprofit
2626 stakeholders to develop a comprehensive strategic plan to ensure
2727 ongoing semiconductor innovation;
2828 (2) sustain the leadership of this state in advanced
2929 semiconductor research, design, and manufacturing;
3030 (3) attract public and private investment in this
3131 state related to research, development, commercialization, and
3232 manufacturing of semiconductors;
3333 (4) identify and expand opportunities for workforce
3434 training and development related to the research, design, and
3535 manufacturing of semiconductors; and
3636 (5) establish a forum for public and private
3737 stakeholders across the semiconductor manufacturing industry in
3838 this state to focus on education, research and development, and
3939 commercial production.
4040 Sec. 481.653. COMPOSITION OF CONSORTIUM. (a) The
4141 consortium is composed of a designee of each of the following
4242 institutions of higher education appointed by the office of the
4343 president of the institution:
4444 (1) The University of Texas at Arlington;
4545 (2) The University of Texas at Austin;
4646 (3) The University of Texas at Dallas;
4747 (4) The University of Texas at El Paso;
4848 (5) The University of Texas Rio Grande Valley;
4949 (6) The University of Texas at San Antonio;
5050 (7) Texas A&M University;
5151 (8) Prairie View A&M University;
5252 (9) the University of Houston;
5353 (10) the University of North Texas;
5454 (11) Texas Tech University;
5555 (12) Texas State University;
5656 (13) Texas State Technical College System;
5757 (14) Lamar University;
5858 (15) Lamar State College - Orange;
5959 (16) Lamar State College - Port Arthur;
6060 (17) Lamar Institute of Technology;
6161 (18) Austin Community College; and
6262 (19) Dallas Community College.
6363 (b) In addition to the appointments under Subsection (a),
6464 the executive committee established under Section 481.655 may
6565 appoint any other entity or individual the executive committee
6666 considers necessary.
6767 (c) In making appointments under Subsections (a) and (b),
6868 priority shall be given to individuals with experience in
6969 semiconductor design and manufacturing.
7070 Sec. 481.654. ADMINISTRATIVE ATTACHMENT. (a) The
7171 consortium is administratively attached to the office of the
7272 governor.
7373 (b) The office shall provide the staff and facilities
7474 necessary to assist the consortium in performing the consortium's
7575 duties under this subchapter.
7676 Sec. 481.655. EXECUTIVE COMMITTEE COMPOSITION. (a) The
7777 consortium is governed by an executive committee composed of the
7878 following members:
7979 (1) three members appointed by the governor;
8080 (2) two members appointed by the lieutenant governor;
8181 (3) two members appointed by the speaker of the house
8282 of representatives;
8383 (4) the chancellor of The Texas A&M University System
8484 or the chancellor's designee; and
8585 (5) the chancellor of The University of Texas System
8686 or the chancellor's designee.
8787 (b) In making appointments under Subsection (a), priority
8888 shall be given to individuals with experience in manufacturing,
8989 design, industrial development, academic research, and scientific
9090 research in the field of semiconductors.
9191 (c) In making appointments under Subsection (a), the
9292 governor, the lieutenant governor, and the speaker of the house of
9393 representatives shall coordinate to ensure that at least two
9494 representatives from the commercial semiconductor design and
9595 manufacturing sectors with an established presence in the state are
9696 appointed to the executive committee.
9797 Sec. 481.656. DUTIES OF EXECUTIVE COMMITTEE. (a) The
9898 executive committee shall:
9999 (1) develop and execute a comprehensive statewide
100100 strategic plan to further the objectives of the consortium as
101101 established under Section 481.652;
102102 (2) solicit recommendations from consortium members
103103 on funding and research opportunities related to semiconductor
104104 research, design, commercialization, and manufacturing;
105105 (3) appoint an executive director of the consortium
106106 and determine the title, functions, duties, powers, and salary for
107107 the executive director; and
108108 (4) prepare and submit the report required by Section
109109 481.657.
110110 (b) The executive director may enter into agreements with
111111 the office of the governor for staff support services to facilitate
112112 the work of the consortium.
113113 Sec. 481.657. BIENNIAL REPORT. Not later than December 1 of
114114 each even-numbered year, the executive committee shall prepare and
115115 submit to the governor and the Legislative Budget Board a written
116116 report that outlines:
117117 (1) activities undertaken to meet the purposes of the
118118 consortium under Section 481.652;
119119 (2) a summary of the funding and research
120120 opportunities identified under Section 481.656(a)(2);
121121 (3) any legislative recommendations to further the
122122 purposes of the consortium;
123123 (4) any prospective grants or funding the consortium
124124 members expect to apply for or receive; and
125125 (5) any research accomplishments associated with the
126126 consortium.
127127 Sec. 481.658. TEXAS SEMICONDUCTOR INNOVATION FUND. (a)
128128 The Texas Semiconductor Innovation Fund is created as a dedicated
129129 account within the general revenue fund. The fund consists of:
130130 (1) gifts, grants, or donations to the fund; and
131131 (2) money from any other source designated by the
132132 legislature.
133133 (b) Money in the fund may be used to:
134134 (1) provide matching funding to state entities,
135135 including institutions of higher education, for semiconductor
136136 manufacturing and design projects;
137137 (2) award grants to business entities with an
138138 established presence in this state to encourage economic
139139 development related to semiconductor manufacturing and design; and
140140 (3) subject to Subsection (c), pay for staff support
141141 services described by Section 481.656(b).
142142 (c) The consortium shall request from the Legislative
143143 Budget Board approval to use money in the fund for the purpose
144144 described by Subsection (b)(3). A request under this subsection
145145 shall be considered approved on the 30th day after receipt by the
146146 Legislative Budget Board unless expressly disapproved.
147147 SECTION 2. This Act takes effect immediately if it receives
148148 a vote of two-thirds of all the members elected to each house, as
149149 provided by Section 39, Article III, Texas Constitution. If this
150150 Act does not receive the vote necessary for immediate effect, this
151151 Act takes effect September 1, 2023.
