55 AN ACT
66 relating to a standard and set of indicators in the academic
77 accountability system.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 39.053(a), Education Code, is amended to
1010 read as follows:
1111 (a) The commissioner shall adopt a set of indicators of the
1212 quality of learning and achievement, including the indicators under
1313 Subsection (c). The commissioner periodically shall review the
1414 indicators for the consideration of appropriate revisions and
1515 ensure a cut score necessary for a district to receive an "A".
1616 (a-1) The indicators adopted by the commissioner under
1717 Subsection (a) must measure and evaluate school districts and
1818 campuses with respect to:
1919 (1) improving student preparedness for success in:
2020 (A) subsequent grade levels; and
2121 (B) entering the workforce, the military, or
2222 postsecondary education;
2323 (2) reducing, with the goal of eliminating, student
2424 academic achievement differentials among students from different
2525 racial and ethnic groups and socioeconomic backgrounds; and
2626 (3) informing parents and the community regarding
2727 campus and district performance.
2828 (b) Performance on the achievement indicators adopted under
2929 Subsection (c) shall be compared to state-established standards.
3030 The indicators must be based on information that is disaggregated
3131 by race, ethnicity, and socioeconomic status.
3232 (c) School districts and campuses must be evaluated based on
3333 three domains of indicators of achievement adopted under this
3434 section that include:
3535 (1) in the student achievement domain, indicators of
3636 student achievement that must include:
3737 (A) for evaluating the performance of districts
3838 and campuses generally:
3939 (i) an indicator that accounts for the
4040 results of assessment instruments required under Sections
4141 39.023(a), (c), and (l), as applicable for the district and campus,
4242 including the results of assessment instruments required for
4343 graduation retaken by a student, aggregated across grade levels by
4444 subject area, including:
4545 (a) for the performance standard
4646 determined by the commissioner under Section 39.0241(a), the
4747 percentage of students who performed satisfactorily on the
4848 assessment instruments, aggregated across grade levels by subject
4949 area; and
5050 (b) for the college readiness
5151 performance standard as determined under Section 39.0241, the
5252 percentage of students who performed satisfactorily on the
5353 assessment instruments, aggregated across grade levels by subject
5454 area; and
5555 (ii) an indicator that accounts for the
5656 results of assessment instruments required under Section
5757 39.023(b), as applicable for the district and campus, including the
5858 percentage of students who performed satisfactorily on the
5959 assessment instruments, as determined by the performance standard
6060 adopted by the agency, aggregated across grade levels by subject
6161 area; and
6262 (B) for evaluating the performance of high school
6363 campuses and districts that include high school campuses,
6464 indicators that account for:
6565 (i) students who satisfy the Texas Success
6666 Initiative (TSI) college readiness benchmarks prescribed by the
6767 Texas Higher Education Coordinating Board under Section 51.334 on
6868 an assessment instrument in reading or mathematics designated by
6969 the coordinating board under that section;
7070 (ii) students who satisfy relevant
7171 performance standards on advanced placement tests or similar
7272 assessments;
7373 (iii) students who earn dual course credits
7474 in the dual credit courses;
7575 (iv) students who enlist in the armed
7676 forces of the United States or the Texas National Guard;
7777 (v) students who earn industry
7878 certifications;
7979 (vi) students admitted into postsecondary
8080 industry certification programs that require as a prerequisite for
8181 entrance successful performance at the secondary level;
8282 (vii) students whose successful completion
8383 of a course or courses under Section 28.014 indicates the student's
8484 preparation to enroll and succeed, without remediation, in an
8585 entry-level general education course for a baccalaureate degree or
8686 associate degree;
8787 (viii) students who successfully met
8888 standards on a composite of indicators that through research
8989 indicates the student's preparation to enroll and succeed, without
9090 remediation, in an entry-level general education course for a
9191 baccalaureate degree or associate degree;
9292 (ix) high school graduation rates, computed
9393 in accordance with standards and definitions adopted in compliance
9494 with the Every Student Succeeds Act (20 U.S.C. Section 6301 et seq.)
9595 subject to the exclusions provided by Subsections (g), (g-1),
9696 (g-2), (g-3), and (g-4);
9797 (x) students who successfully completed an
9898 OnRamps dual enrollment course;
9999 (xi) students who successfully completed a
100100 practicum or internship approved by the State Board of Education;
101101 (xii) students who are awarded an associate
102102 degree; and
103103 (xiii) students who successfully completed
104104 a program of study in career and technical education;
105105 (2) in the school progress domain, indicators for
106106 effectiveness in promoting student learning, which must include:
107107 (A) for assessment instruments, including
108108 assessment instruments under Subdivisions (1)(A)(i) and (ii), the
109109 percentage of students who met the standard for improvement, as
110110 determined by the commissioner; and
111111 (B) for evaluating relative performance, the
112112 performance of districts and campuses compared to similar districts
113113 or campuses; and
114114 (3) in the closing the gaps domain, the use of
115115 disaggregated data to demonstrate the differentials among students
116116 from different racial and ethnic groups, socioeconomic
117117 backgrounds, and other factors, including:
118118 (A) students formerly receiving special
119119 education services;
120120 (B) students continuously enrolled; and
121121 (C) students who are mobile.
122122 (c-1) An indicator adopted under Subsection (c) that would
123123 measure improvements in student achievement cannot negatively
124124 affect the commissioner's review of a school district or campus if
125125 that district or campus is already achieving at the highest level
126126 for that indicator.
127127 (c-2) The commissioner by rule shall determine a method by
128128 which a student's performance may be included in determining the
129129 performance rating of a school district or campus under Section
130130 39.054 if, before the student graduates, the student:
131131 (1) satisfies the Texas Success Initiative (TSI)
132132 college readiness benchmarks prescribed by the Texas Higher
133133 Education Coordinating Board under Section 51.334 on an assessment
134134 instrument designated by the coordinating board under that section;
135135 or
136136 (2) performs satisfactorily on an assessment
137137 instrument under Section 39.023(c), notwithstanding Subsection (d)
138138 of this section.
139139 (c-3) Any standard for improvement determined by the
140140 commissioner as described by Subsection (c)(2)(A) must allow for
141141 appropriately crediting a student for growth if the student
142142 performs at the highest achievement standard in the previous and
143143 current school year.
144144 (d) For purposes of Subsection (c), the commissioner by rule
145145 shall determine the period within which a student must retake an
146146 assessment instrument for that assessment instrument to be
147147 considered in determining the performance rating of the district
148148 under Section 39.054.
149149 (d-1) In aggregating results of assessment instruments
150150 across grade levels by subject in accordance with Subsection
151151 (c)(1)(A)(i), the performance of a student enrolled below the high
152152 school level on an assessment instrument required under Section
153153 39.023(c) is included with results relating to other students
154154 enrolled at the same grade level.
155155 (e) For purposes of Subsection (c)(3)(A), a student
156156 formerly receiving special education services means a student whose
157157 enrollment information:
158158 (1) for the preceding school year, as reported through
159159 the Public Education Information Management System (PEIMS),
160160 indicates the student was enrolled at the campus and was
161161 participating in a special education program; and
162162 (2) for the current school year, as reported through
163163 the Public Education Information Management System (PEIMS) and as
164164 reported on assessment instruments administered to the student
165165 under Section 39.023, indicates the student is enrolled at the
166166 campus and is not participating in a special education program.
167167 (f) Annually, the commissioner shall define the state
168168 standard for the current school year for each achievement indicator
169169 adopted under this section. In consultation with educators,
170170 parents, and business and industry representatives, as necessary,
171171 the commissioner shall establish and modify standards to
172172 continuously improve student performance to achieve the goals of
173173 eliminating achievement gaps based on race, ethnicity, and
174174 socioeconomic status and to ensure this state is a national leader
175175 in preparing students for postsecondary success.
176176 SECTION 2. This Act applies beginning with the 2023-2024
177177 school year.
178178 SECTOIN 3. This Act takes effect immediately if it receives
179179 a vote of two-thirds of all the members elected to each house, as
180180 provided by Section 39, Article III, Texas Constitution. If this
181181 Act does not receive the vote necessary for immediate effect, this
182182 Act takes effect September 1, 2023.
