66 relating to the creation of a bulk ammunition database.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Chapter 411, Government Code, is amended by
99 adding Subchapter S to read as follows:
1010 SUBCHAPTER S
1111 BULK AMMUNITION DATABASE
1212 Sec. 411.601. DEFINITIONS. In this subchapter:
1313 (1) "ammunition" means any cartridge, shell, or
1414 projectile intended for use in a firearm;
1515 (2) "bulk purchase" means the purchase of 200 or more
1616 rounds of ammunition at one time; and
1717 (3) "database" means the bulk ammunition database
1818 established under this statute.
1919 Sec. 411.602. BULK AMMUNITION DATABASE. (a) All persons
2020 selling ammunition in quantities greater than 200 rounds shall
2121 register with the database and provide information on the sale,
2222 including the date of sale, the name and address of the purchaser,
2323 and the type and quantity of ammunition sold.
2424 (b) All persons purchasing ammunition in quantities greater
2525 than 200 rounds shall provide their name and address to the seller,
2626 who shall forward this information to the database.
2727 (c) The database shall be maintained by the department and
2828 shall be accessible to law enforcement for the purpose of verifying
2929 the legality of ammunition sales.
3030 Sec. 411.603. REQUIREMENTS FOR CERTAIN AMMUNITION
3131 PURCHASES. (a) All persons purchasing ammunition in quantities
3232 greater than 200 rounds shall undergo a background check prior to
3333 the sale. The background check shall be performed by a licensed
3434 firearms dealer and shall include a check of the National Instant
3535 Criminal Background Check System (NICS) and any other relevant
3636 databases.
3737 (b) The seller shall verify that the background check has
3838 been completed and that the purchaser is not prohibited from
3939 possessing ammunition before making the sale.
4040 Sec. 411.604. CRIMINAL PENALTIES. (a) Any person who
4141 knowingly violates the provisions of this subchapter shall be
4242 guilty of a Class A misdemeanor.
4343 (b) Any person who knowingly makes a false statement on a
4444 bulk ammunition sale form shall be guilty of a third degree felony.
4545 SECTION 2. This Act takes effect September 1, 2023.
