| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Chapter 411, Government Code, is amended by |
|---|
| 9 | 9 | | adding Subchapter S to read as follows: |
|---|
| 10 | 10 | | SUBCHAPTER S |
|---|
| 11 | 11 | | BULK AMMUNITION DATABASE |
|---|
| 12 | 12 | | Sec. 411.601. DEFINITIONS. In this subchapter: |
|---|
| 13 | 13 | | (1) "ammunition" means any cartridge, shell, or |
|---|
| 14 | 14 | | projectile intended for use in a firearm; |
|---|
| 15 | 15 | | (2) "bulk purchase" means the purchase of 200 or more |
|---|
| 16 | 16 | | rounds of ammunition at one time; and |
|---|
| 17 | 17 | | (3) "database" means the bulk ammunition database |
|---|
| 18 | 18 | | established under this statute. |
|---|
| 19 | 19 | | Sec. 411.602. BULK AMMUNITION DATABASE. (a) All persons |
|---|
| 20 | 20 | | selling ammunition in quantities greater than 200 rounds shall |
|---|
| 21 | 21 | | register with the database and provide information on the sale, |
|---|
| 22 | 22 | | including the date of sale, the name and address of the purchaser, |
|---|
| 23 | 23 | | and the type and quantity of ammunition sold. |
|---|
| 24 | 24 | | (b) All persons purchasing ammunition in quantities greater |
|---|
| 25 | 25 | | than 200 rounds shall provide their name and address to the seller, |
|---|
| 26 | 26 | | who shall forward this information to the database. |
|---|
| 27 | 27 | | (c) The database shall be maintained by the department and |
|---|
| 28 | 28 | | shall be accessible to law enforcement for the purpose of verifying |
|---|
| 29 | 29 | | the legality of ammunition sales. |
|---|
| 30 | 30 | | Sec. 411.603. REQUIREMENTS FOR CERTAIN AMMUNITION |
|---|
| 31 | 31 | | PURCHASES. (a) All persons purchasing ammunition in quantities |
|---|
| 32 | 32 | | greater than 200 rounds shall undergo a background check prior to |
|---|
| 33 | 33 | | the sale. The background check shall be performed by a licensed |
|---|
| 34 | 34 | | firearms dealer and shall include a check of the National Instant |
|---|
| 35 | 35 | | Criminal Background Check System (NICS) and any other relevant |
|---|
| 36 | 36 | | databases. |
|---|
| 37 | 37 | | (b) The seller shall verify that the background check has |
|---|
| 38 | 38 | | been completed and that the purchaser is not prohibited from |
|---|
| 39 | 39 | | possessing ammunition before making the sale. |
|---|
| 40 | 40 | | Sec. 411.604. CRIMINAL PENALTIES. (a) Any person who |
|---|
| 41 | 41 | | knowingly violates the provisions of this subchapter shall be |
|---|
| 42 | 42 | | guilty of a Class A misdemeanor. |
|---|
| 43 | 43 | | (b) Any person who knowingly makes a false statement on a |
|---|
| 44 | 44 | | bulk ammunition sale form shall be guilty of a third degree felony. |
|---|
| 45 | 45 | | SECTION 2. This Act takes effect September 1, 2023. |
