55 AN ACT
66 relating to the requirements for the purchase of ammunition;
77 creating an offense.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter H, Government Code, is amended by
1010 adding Section 411.210 to read as follows:
1111 Sec. 411.210. PURCHASES AND SALES OF AMMUNITION. (a) In
1212 this section "ammunition" means any cartridge, shell, or projectile
1313 intended for use in a firearm.
1414 (b) A person commits an offense if the person intentionally
1515 or knowingly sells ammunition and the person accepts anything other
1616 than the following as payment for the ammunition:
1717 (1) United States currency;
1818 (2) a negotiable instrument in the form of a check that
1919 meets the requirements of Section 3.104, Business & Commerce Code;
2020 and
2121 (3) a debit made through a financial institution debit
2222 card.
2323 (c) A person commits an offense if the person intentionally
2424 or knowingly sells ammunition for a firearm to a person who is
2525 younger than 18 years of age.
2626 (d) A person commits an offense if the person intentionally
2727 or knowingly sells ammunition for a firearm to a person without
2828 verifying the age of the purchaser by examining a driver's license
2929 or identification card issued by the state or by the United States
3030 government, a passport, or other government-issued documentation
3131 that provides the person's name, date of birth, and photograph.
3232 (e) An offense under this section is a Class A misdemeanor.
3333 SECTION 2. This Act takes effect September 1, 2023.
