6 | 6 | | relating to the requirements for the purchase of ammunition; |

7 | 7 | | creating an offense. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Subchapter H, Government Code, is amended by |
---|
10 | 10 | | adding Section 411.210 to read as follows: |

11 | 11 | | Sec. 411.210. PURCHASES AND SALES OF AMMUNITION. (a) In |
---|
12 | 12 | | this section "ammunition" means any cartridge, shell, or projectile |
---|
13 | 13 | | intended for use in a firearm. |
---|
14 | 14 | | (b) A person commits an offense if the person intentionally |
---|
15 | 15 | | or knowingly sells ammunition and the person accepts anything other |
---|
16 | 16 | | than the following as payment for the ammunition: |
---|
17 | 17 | | (1) United States currency; |
---|
18 | 18 | | (2) a negotiable instrument in the form of a check that |
---|
19 | 19 | | meets the requirements of Section 3.104, Business & Commerce Code; |
---|
20 | 20 | | and |
---|
21 | 21 | | (3) a debit made through a financial institution debit |
---|
22 | 22 | | card. |
---|
23 | 23 | | (c) A person commits an offense if the person intentionally |
---|
24 | 24 | | or knowingly sells ammunition for a firearm to a person who is |
---|
25 | 25 | | younger than 18 years of age. |
---|
26 | 26 | | (d) A person commits an offense if the person intentionally |
---|
27 | 27 | | or knowingly sells ammunition for a firearm to a person without |
---|
28 | 28 | | verifying the age of the purchaser by examining a driver's license |
---|
29 | 29 | | or identification card issued by the state or by the United States |
---|
30 | 30 | | government, a passport, or other government-issued documentation |
---|
31 | 31 | | that provides the person's name, date of birth, and photograph. |
---|
32 | 32 | | (e) An offense under this section is a Class A misdemeanor. |
---|
33 | 33 | | SECTION 2. This Act takes effect September 1, 2023. |
