| 6 | 6 | | relating to an open-enrollment charter school expansion amendment. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 12.114, Education Code, is amended to |
|---|
| 9 | 9 | | add Subsection (e) to read as follows: |
|---|
| 10 | 10 | | (e) A request for approval for an expansion amendment shall |
|---|
| 11 | 11 | | be accompanied by prior-years data, specified by the commissioner |
|---|
| 12 | 12 | | in the request form, regarding the open-enrollment charter school's |
|---|
| 13 | 13 | | allotment and expenditures for special education and its special |
|---|
| 14 | 14 | | education practices, including enrollment, discipline, and |
|---|
| 15 | 15 | | staffing. The commissioner shall thoroughly review and make public |
|---|
| 16 | 16 | | the charter school's special education funding and practices, |
|---|
| 17 | 17 | | including the data submitted, before acting on the request. |
|---|
| 18 | 18 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 19 | 19 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 20 | 20 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 21 | 21 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 22 | 22 | | Act takes effect September 1, 2023. |
