| 7 | 7 | | fee related to building, zoning, or operating certain child-care |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 250, Local Government Code, is amended |
|---|
| 11 | 11 | | by adding Section 250.014 to read as follows: |
|---|
| 12 | 12 | | Sec. 250.014. FEE TO OPERATE CERTAIN CHILD-CARE BUSINESSES |
|---|
| 13 | 13 | | PROHIBITED. (a) In this section, "child-care facility", "day-care |
|---|
| 14 | 14 | | center", "family home", and "group day-care home" have the meanings |
|---|
| 15 | 15 | | assigned by Section 42.002, Human Resources Code, with the |
|---|
| 16 | 16 | | exception of an entity for which subsection 11.20(c) of the |
|---|
| 17 | 17 | | Property Tax Code applies. |
|---|
| 18 | 18 | | (b) Notwithstanding any other law, a municipality or county |
|---|
| 19 | 19 | | may not require a person or organization to pay a fee related to |
|---|
| 20 | 20 | | building, zoning, or operating a licensed child-care facility or |
|---|
| 21 | 21 | | day-care center. |
|---|
| 22 | 22 | | (c) Notwithstanding any other law, a municipality or county |
|---|
| 23 | 23 | | may not require a person or organization to pay a fee related to |
|---|
| 24 | 24 | | zoning or operating a family home or group day-care home. |
|---|
| 25 | 25 | | (d) This section shall not be construed to relieve a |
|---|
| 26 | 26 | | licensed child-care facility, day-care center, family home, or |
|---|
| 27 | 27 | | group day-care home from acquiring the permits and inspections |
|---|
| 28 | 28 | | required by a municipality or county for building, rezoning, or |
|---|
| 29 | 29 | | operating. |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect September 1, 2023. |
