| 7 | 7 | | schools receiving state money. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Chapter 1, Education Code, is amended by adding |
|---|
| 10 | 10 | | Section 1.0025 to read as follows: |
|---|
| 11 | 11 | | Sec. 1.0025. LIMITATIONS ON PRIVATE SCHOOLS RECEIVING STATE |
|---|
| 12 | 12 | | MONEY. (a) In this section, "private school" has the meaning |
|---|
| 13 | 13 | | assigned by Section 5.001. |
|---|
| 14 | 14 | | (b) This section applies to: |
|---|
| 15 | 15 | | (1) a private school that receives state money under |
|---|
| 16 | 16 | | an education savings account program or similar program established |
|---|
| 17 | 17 | | under a provision of this code through which a child may use state |
|---|
| 18 | 18 | | money for nonpublic primary or secondary education, regardless of |
|---|
| 19 | 19 | | when that program is established; and |
|---|
| 20 | 20 | | (2) a private school belonging to the same network of |
|---|
| 21 | 21 | | schools as a private school described by Subdivision (1). |
|---|
| 22 | 22 | | (c) Notwithstanding any other law, a private school to which |
|---|
| 23 | 23 | | this section applies may not compensate any individual who is not |
|---|
| 24 | 24 | | directly related to the teaching of or caring for students enrolled |
|---|
| 25 | 25 | | at the school or administering the school's academic programs. |
|---|
| 26 | 26 | | This prohibition on compensation includes an individual who made a |
|---|
| 27 | 27 | | financial investment directly or indirectly to the private school. |
|---|
| 28 | 28 | | (d) The Texas Education Agency shall adopt rules to provide |
|---|
| 29 | 29 | | for sanctions for a private school found to be not in compliance |
|---|
| 30 | 30 | | with this section. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect September 1, 2023. |
