44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to certain limitations on private primary or secondary
77 schools receiving state money.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 1, Education Code, is amended by adding
1010 Section 1.0025 to read as follows:
1111 Sec. 1.0025. LIMITATIONS ON PRIVATE SCHOOLS RECEIVING STATE
1212 MONEY. (a) In this section, "private school" has the meaning
1313 assigned by Section 5.001.
1414 (b) This section applies to:
1515 (1) a private school that receives state money under
1616 an education savings account program or similar program established
1717 under a provision of this code through which a child may use state
1818 money for nonpublic primary or secondary education, regardless of
1919 when that program is established; and
2020 (2) a private school belonging to the same network of
2121 schools as a private school described by Subdivision (1).
2222 (c) Notwithstanding any other law, a private school to which
2323 this section applies may not compensate any individual who is not
2424 directly related to the teaching of or caring for students enrolled
2525 at the school or administering the school's academic programs.
2626 This prohibition on compensation includes an individual who made a
2727 financial investment directly or indirectly to the private school.
2828 (d) The Texas Education Agency shall adopt rules to provide
2929 for sanctions for a private school found to be not in compliance
3030 with this section.
3131 SECTION 2. This Act takes effect September 1, 2023.
