66 AN ACT
77 relating to an employment preference for members of the military
88 and their spouses for positions at state agencies.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 656.027, Government Code, is amended to
1111 read as follows:
1212 Sec. 656.027. MILITARY EMPLOYMENT PREFERENCE [FOR
1313 VETERANS] ON STATE EMPLOYMENT FORMS. The commission shall include
1414 on all forms relating to state agency employment that are
1515 prescribed by the commission under this subchapter or other law a
1616 statement regarding the requirement prescribed by Chapter 657 that
1717 each state agency give a military [veterans] employment preference
1818 until the agency workforce is composed of at least 20 [40] percent
1919 individuals who qualify for a military employment preference under
2020 Section 657.002 [veterans].
2121 SECTION 2. The heading to Chapter 657, Government Code, is
2222 amended to read as follows:
2323 CHAPTER 657. MILITARY [VETERAN'S] EMPLOYMENT PREFERENCES
2424 SECTION 3. Section 657.002, Government Code, is amended to
2525 read as follows:
2626 Sec. 657.002. INDIVIDUALS QUALIFIED FOR MILITARY
2727 [VETERAN'S] EMPLOYMENT PREFERENCE. The following individuals
2828 qualify for a military [veteran's] employment preference:
2929 (1) a veteran, including a veteran with a disability;
3030 (2) a veteran's surviving spouse who has not
3131 remarried; [and]
3232 (3) an orphan of a veteran if the veteran was killed
3333 while on active duty; and
3434 (4) the spouse of a member of the United States armed
3535 forces or Texas National Guard serving on active duty.
3636 SECTION 4. Section 657.003, Government Code, is amended to
3737 read as follows:
3838 Sec. 657.003. MILITARY [VETERAN'S] EMPLOYMENT PREFERENCE.
3939 (a) An individual who qualifies for a military [veteran's]
4040 employment preference is entitled to a preference in employment
4141 with or appointment to a state agency over other applicants for the
4242 same position who do not have a greater qualification.
4343 (b) A state agency shall provide to an individual entitled
4444 to a military [veteran's] employment preference for employment or
4545 appointment over other applicants for the same position who do not
4646 have a greater qualification a military [veteran's] employment
4747 preference, in the following order of priority:
4848 (1) a veteran with a disability;
4949 (2) a veteran;
5050 (3) a spouse of a member of the United States armed
5151 forces or Texas National Guard serving on active duty as described
5252 by Section 657.002(4);
5353 (4) a veteran's surviving spouse who has not
5454 remarried; and
5555 (5) [(4)] an orphan of a veteran if the veteran was
5656 killed while on active duty.
5757 (c) If a state agency requires a competitive examination
5858 under a merit system or civil service plan for selecting or
5959 promoting employees, an individual entitled to a military
6060 [veteran's] employment preference who otherwise is qualified for
6161 that position and who has received at least the minimum required
6262 score for the test is entitled to have a service credit of 10 points
6363 added to the test score. A veteran with a disability is entitled to
6464 have a service credit of five additional points added to the
6565 individual's test score.
6666 (d) An individual entitled to a military [veteran's]
6767 employment preference is not disqualified from holding a position
6868 with a state agency because of age or an established
6969 service-connected disability if the age or disability does not make
7070 the individual incompetent to perform the duties of the position.
7171 SECTION 5. Section 657.0045, Government Code, is amended to
7272 read as follows:
7373 Sec. 657.0045. DESIGNATION OF OPEN POSITION FOR AND
7474 IMMEDIATE HIRING OF INDIVIDUAL ENTITLED TO MILITARY [VETERAN'S]
7575 EMPLOYMENT PREFERENCE. (a) A state agency may designate an open
7676 position as a military preference [veteran's] position and only
7777 accept applications for that position from individuals who are
7878 entitled to a military [veteran's] employment preference under
7979 Section 657.003.
8080 (b) Notwithstanding any other law, a state agency may hire
8181 or appoint for an open position within the agency an individual
8282 entitled to a military [veteran's] employment preference under
8383 Section 657.003 without announcing or advertising the position if
8484 the agency:
8585 (1) uses the automated labor exchange system
8686 administered by the Texas Workforce Commission to identify an
8787 individual who qualifies for a military [veteran's] employment
8888 preference under this chapter; and
8989 (2) determines the individual meets the
9090 qualifications required for the position.
9191 SECTION 6. Section 657.0046, Government Code, is amended to
9292 read as follows:
9393 Sec. 657.0046. STATE AGENCY [VETERAN'S] LIAISON FOR
9494 VETERANS, MILITARY MEMBERS, AND THEIR DEPENDENTS. (a) Each state
9595 agency that has at least 500 full-time equivalent positions shall
9696 designate an individual from the agency to serve as a [veteran's]
9797 liaison for veterans, military members, and their dependents.
9898 (b) A state agency that has fewer than 500 full-time
9999 equivalent positions may designate an individual from the agency to
100100 serve as the [a veteran's] liaison described by Subsection (a).
101101 (c) Each state agency that designates a [veteran's] liaison
102102 under this section shall make available on the agency's Internet
103103 website the liaison's individual work contact information.
104104 SECTION 7. Section 657.0047, Government Code, is amended to
105105 read as follows:
106106 Sec. 657.0047. INTERVIEWS AT STATE AGENCIES. (a) For each
107107 announced open position at a state agency, the state agency shall
108108 interview:
109109 (1) if the total number of individuals interviewed for
110110 the position is six or fewer, at least one individual qualified for
111111 a military [veteran's] employment preference under Section
112112 657.003; or
113113 (2) if the total number of individuals interviewed for
114114 the position is more than six, a number of individuals qualified for
115115 a military [veteran's] employment preference under Section 657.003
116116 equal to at least 20 percent of the total number interviewed.
117117 (b) A state agency that does not receive any applications
118118 from individuals who qualify for a military [veteran's] employment
119119 preference under Section 657.003 is not required to comply with
120120 Subsection (a).
121121 SECTION 8. Section 657.005(a), Government Code, is amended
122122 to read as follows:
123123 (a) The individual whose duty is to appoint or employ an
124124 applicant for a position with a state agency or an officer or the
125125 chief administrator of the agency who receives an application for
126126 appointment or employment by an individual entitled to a military
127127 [veteran's] employment preference, before appointing or employing
128128 any individual, shall investigate the qualifications of the
129129 applicant for the position.
130130 SECTION 9. Section 657.010, Government Code, is amended to
131131 read as follows:
132132 Sec. 657.010. COMPLAINT REGARDING EMPLOYMENT DECISION OF
133133 STATE AGENCY. (a) An individual entitled to a military [veteran's]
134134 employment preference under this chapter who is aggrieved by a
135135 decision of a state agency to which this chapter applies relating to
136136 hiring or appointing the individual, or relating to retaining the
137137 individual if the state agency reduces its workforce, may appeal
138138 the decision by filing a written complaint with the executive
139139 director of the state agency under this section.
140140 (b) The executive director of a state agency that receives a
141141 written complaint under Subsection (a) shall respond to the
142142 complaint not later than the 15th business day after the date the
143143 executive director receives the complaint. The executive director
144144 may render a different hiring or appointment decision than the
145145 decision that is the subject of the complaint if the executive
146146 director determines that the military [veteran's] preference was
147147 not applied.
148148 SECTION 10. Section 32.54(b), Penal Code, is amended to
149149 read as follows:
150150 (b) A person commits an offense if the person:
151151 (1) uses or claims to hold a military record that the
152152 person knows:
153153 (A) is fraudulent;
154154 (B) is fictitious or has otherwise not been
155155 granted or assigned to the person; or
156156 (C) has been revoked; and
157157 (2) uses or claims to hold that military record:
158158 (A) in a written or oral advertisement or other
159159 promotion of a business; or
160160 (B) with the intent to:
161161 (i) obtain priority in receiving services
162162 or resources under Subchapter G, Chapter 302, Labor Code;
163163 (ii) qualify for a military [veteran's]
164164 employment preference under Chapter 657, Government Code;
165165 (iii) obtain a license or certificate to
166166 practice a trade, profession, or occupation;
167167 (iv) obtain a promotion, compensation, or
168168 other benefit, or an increase in compensation or other benefit, in
169169 employment or in the practice of a trade, profession, or
170170 occupation;
171171 (v) obtain a benefit, service, or donation
172172 from another person;
173173 (vi) obtain admission to an educational
174174 program in this state; or
175175 (vii) gain a position in state government
176176 with authority over another person, regardless of whether the actor
177177 receives compensation for the position.
178178 SECTION 11. The changes in law made by this Act to Chapter
179179 657, Government Code, apply only to an open position with a state
180180 agency for which the state agency begins accepting applications on
181181 or after the effective date of this Act. An open position with a
182182 state agency for which the state agency begins accepting
183183 applications before the effective date of this Act is governed by
184184 the law in effect on the date the state agency began accepting
185185 applications, and the former law is continued in effect for that
186186 purpose.
187187 SECTION 12. This Act takes effect September 1, 2023.
