A BILL TO BE ENTITLED
AN ACT
relating to the statute of limitations for a suit on performance
bonds.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Sec. 2253.078(a), Government Code, is amended to
read as follows:
(a) A suit on a performance bond may not be brought after the
first anniversary of the earlier of: (1) the date of final
completion, (2) the date of abandonment, or (3) the date of
termination of the public work contract.
SECTION 2. This act takes effect September 1, 2023.
