5	5	AN ACT
6	6	relating to the expenses and methods of financing the operations of
7	7	certain state licensing or regulatory agencies and related
8	8	agencies.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Chapter 51, Occupations Code, is amended by
11	11	adding Section 51.1031 to read as follows:
12	12	Sec. 51.1031. EXPENSE SHARING ARRANGEMENT. The executive
13	13	director may enter into an agreement with another state agency to
14	14	share costs and expenses.
15	15	SECTION 2. Section 101.006, Occupations Code, is amended to
16	16	read as follows:
17	17	Sec. 101.006. BUDGET. The council shall adopt an annual
18	18	budget that is funded by a prorated assessment paid by the
19	19	regulatory agencies listed in Section 101.002 and as may be
20	20	provided by the general appropriations act.
21	21	SECTION 3. Chapter 101, Occupations Code, is amended by
22	22	adding Section 101.0061 to read as follows:
23	23	Sec. 101.0061. EXPENSE SHARING ARRANGEMENT. The council
24	24	may enter into an agreement with another state agency to share costs
25	25	and expenses.
26	26	SECTION 4. Section 201.153, Occupations Code, is amended by
27	27	adding a Subsection (b) to read as follows:
28	28	(b) The board by rule may set temporary fees in amounts
29	29	reasonable and necessary to cover nonrecurring costs of
30	30	administering this chapter.
31	31	SECTION 5. Chapter 801, Occupations Code, is amended by
32	32	adding Section 801.1021 to read as follows:
33	33	Sec. 801.1021. EXPENSE SHARING ARRANGEMENT. The executive
34	34	director may enter into an agreement with another state agency to
35	35	share costs and expenses.
36	36	SECTION 6. Section 801.154, Occupations Code, is amended to
37	37	read as follows:
38	38	Sec. 801.154. FEES. The board by rule shall set fees in
39	39	amounts that are reasonable and necessary so that the fees, in the
40	40	aggregate, cover the costs of administering this chapter. The
41	41	board by rule may set temporary fees in amounts reasonable and
42	42	necessary to cover nonrecurring costs of administering this
43	43	chapter.
44	44	SECTION 7. Chapter 1002, Occupations Code, is amended by
45	45	adding Section 1002.1031 to read as follows:
46	46	Sec. 1002.1031. EXPENSE SHARING ARRANGEMENT. The executive
47	47	director may enter into an agreement with another state agency to
48	48	share costs and expenses.
49	49	SECTION 8. Section 1002.152, Occupations Code, is amended
50	50	to read as follows:
51	51	Sec. 1002.152. FEES. The board may set reasonable and
52	52	necessary fees to be charged applicants and license holders under
53	53	this chapter, including fees for application, examination,
54	54	licensure, and renewal of a license. The board shall base a fee for
55	55	examination in a discipline of geoscience on the costs associated
56	56	with preparing, administering, and grading that examination. The
57	57	board by rule may set temporary fees in amounts reasonable and
58	58	necessary to cover nonrecurring costs of administering this
59	59	chapter.
60	60	SECTION 9. This Act takes effect September 1, 2023.
