| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Finance Code, Title 3, Subtitle Z, is amended by |

| 11 | 11 | | adding Chapter 282 to read as follows: |

| 12 | 12 | | CHAPTER 282. DISCRIMINATION AGAINST FIREARMS AND AMMUNITION |
|---|
| 13 | 13 | | Sec. 282.001. DISCRIMINATION AGAINST LAWFUL FIREARMS OR |
|---|
| 14 | 14 | | AMMUNITION COMPANIES PROHIBITED. (a) A financial institution as |
|---|
| 15 | 15 | | defined by Section 201.101 is prohibited from discriminating |
|---|
| 16 | 16 | | against lawful firearms and ammunition industry companies or |
|---|
| 17 | 17 | | businesses based solely upon such a company’s or a business’s |
|---|
| 18 | 18 | | engagement in the constitutionally protected commerce subject |
|---|
| 19 | 19 | | matter of firearms or ammunition. |
|---|
| 20 | 20 | | (b) The banking commissioner shall administer and enforce |
|---|
| 21 | 21 | | this law, and per Finance Code Section 31.101, bring to bear all |
|---|
| 22 | 22 | | administrative remedies, including the de-charter of a financial |
|---|
| 23 | 23 | | institution found to be in violation of this section. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect September 1, 2023. |
