8	8	AN ACT
9	9	relating to fees on and grants for fuel ethanol, renewable methane,
10	10	biodiesel, and renewable diesel.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 16.005(a), Agriculture Code, as amended
13	13	by Chapters 1295 (H.B. 2318) and 1312 (H.B. 2582), Acts of the 81st
14	14	Legislature, Regular Session, 2009, is reenacted to read as
15	15	follows:
16	16	(a) The office shall impose a fee on each producer in an
17	17	amount equal to 3.2 cents for each gallon of fuel ethanol, renewable
18	18	diesel, or MMBtu of renewable methane and 1.6 cents for each gallon
19	19	of biodiesel produced in each registered plant operated by the
20	20	producer.
21	21	SECTION 2. Section 16.006(b), Agriculture Code, as amended
22	22	by Chapters 1295 (H.B. 2318) and 1312 (H.B. 2582), Acts of the 81st
23	23	Legislature, Regular Session, 2009, is reenacted to read as
24	24	follows:
25	25	(b) A producer is entitled to receive from the account 20
26	26	cents for each gallon of fuel ethanol, renewable diesel, or MMBtu of
27	27	renewable methane and 10 cents for each gallon of biodiesel
28	28	produced in each registered plant operated by the producer until
29	29	the 10th anniversary of the date production from the plant begins.
30	30	SECTION 3. This Act takes effect immediately if it receives
31	31	a vote of two-thirds of all the members elected to each house, as
32	32	provided by Section 39, Article III, Texas Constitution. If this
33	33	Act does not receive the vote necessary for immediate effect, this
34	34	Act takes effect September 1, 2023.
