88 AN ACT
99 relating to fees on and grants for fuel ethanol, renewable methane,
1010 biodiesel, and renewable diesel.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 16.005(a), Agriculture Code, as amended
1313 by Chapters 1295 (H.B. 2318) and 1312 (H.B. 2582), Acts of the 81st
1414 Legislature, Regular Session, 2009, is reenacted to read as
1515 follows:
1616 (a) The office shall impose a fee on each producer in an
1717 amount equal to 3.2 cents for each gallon of fuel ethanol, renewable
1818 diesel, or MMBtu of renewable methane and 1.6 cents for each gallon
1919 of biodiesel produced in each registered plant operated by the
2020 producer.
2121 SECTION 2. Section 16.006(b), Agriculture Code, as amended
2222 by Chapters 1295 (H.B. 2318) and 1312 (H.B. 2582), Acts of the 81st
2323 Legislature, Regular Session, 2009, is reenacted to read as
2424 follows:
2525 (b) A producer is entitled to receive from the account 20
2626 cents for each gallon of fuel ethanol, renewable diesel, or MMBtu of
2727 renewable methane and 10 cents for each gallon of biodiesel
2828 produced in each registered plant operated by the producer until
2929 the 10th anniversary of the date production from the plant begins.
3030 SECTION 3. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2023.
