1111 A BILL TO BE ENTITLED
1212 AN ACT
1313 relating to the adoption and use of certain performance indicators
1414 to measure and evaluate career school or college programs.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Subchapter B, Chapter 132, Education Code, is
1717 amended by adding Section 132.027 to read as follows:
1818 Sec. 132.027. PERFORMANCE INDICATORS. (a) In this
1919 section, "institution of higher education" has the meaning assigned
2020 by Section 61.003.
2121 (b) The commission shall adopt a set of performance
2222 indicators for the purpose of measuring and evaluating career
2323 schools or colleges and the quality of the learning and achievement
2424 of students enrolled in programs operated by career schools or
2525 colleges. The commission periodically shall review the indicators
2626 and make appropriate revisions based on that review.
2727 (c) The performance indicators adopted under Subsection (b)
2828 must allow for the assessment of a career school or college program
2929 with respect to:
3030 (1) industry recognition of the program and the
3131 corresponding value that industry attaches to the program and to
3232 any certifications or licenses related to the program;
3333 (2) the rate at which students are able to
3434 successfully complete the program;
3535 (3) the availability of a program-related
3636 certification or license after a student completes the program;
3737 (4) the likelihood that a certification or license
3838 related to the program will:
3939 (A) lead to postsecondary work, an
4040 apprenticeship program, or established industry credentials; or
4141 (B) support employment in this state;
4242 (5) whether a program-related certification or
4343 license will be awarded by an independent third-party organization
4444 using predetermined standards for knowledge, skills, and
4545 competencies;
4646 (6) the inclusion of accepted best practices for the
4747 program that align to best practices contained in:
4848 (A) widely accepted industry standards; or
4949 (B) standards established by an independent
5050 third-party organization with expertise in gathering information
5151 from employers related to the value attached to any certifications
5252 or licenses related to the program; and
5353 (7) for a nursing education program, whether the
5454 program has resulted in a decrease in the number of clinical
5555 practice positions available to students enrolled in nursing
5656 programs in institutions of higher education in the region in which
5757 the program is offered.
5858 (d) The commission shall:
5959 (1) develop a methodology for determining the minimum
6060 acceptable standards for a career school or college based on the
6161 performance indicators adopted under Subsection (b);
6262 (2) evaluate annually between 15 and 20 percent of
6363 career school and college programs in this state for compliance
6464 with the minimum acceptable standards described by Subdivision (1);
6565 and
6666 (3) coordinate with the Texas Board of Nursing and
6767 other appropriate state agencies in implementing and administering
6868 this section.
6969 (e) A career school or college offering a program that fails
7070 to meet the minimum standards developed under Subsection (d) is
7171 ineligible to:
7272 (1) enter into a contract with a local workforce
7373 development board with respect to that program; or
7474 (2) obtain nursing clinical practice positions in this
7575 state until the career school or college provides evidence
7676 satisfactory to the commission and the Texas Board of Nursing that a
7777 nursing education program offered by the career school or college
7878 will not result in a decrease in the number of nursing clinical
7979 practice positions available to students enrolled in nursing
8080 programs in institutions of higher education in the region in which
8181 the program is offered.
8282 (f) Not later than September 1 of each year, the commission
8383 shall publish a list of each career school and college program that
8484 has been reviewed by the commission and that meets the minimum
8585 acceptable standards developed under Subsection (d).
8686 (g) Rules adopted by the commission under Section 132.021
8787 must include rules for the periodic review of performance
8888 indicators.
8989 (h) On request by the commission, the Texas Board of Nursing
9090 and other appropriate state agencies shall coordinate with the
9191 commission for purposes of Subsection (d)(3), including by
9292 providing available data or other information to the commission.
9393 SECTION 2. Not later than September 1, 2025, the Texas
9494 Workforce Commission shall publish the initial list required under
9595 Section 132.027(f), Education Code, as added by this Act.
9696 SECTION 3. This Act takes effect September 1, 2023.
