| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 21.041, Education Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (e) to read as follows: |
|---|
| 12 | 12 | | (e) Before the board submits to the State Board of Education |
|---|
| 13 | 13 | | for approval under Section 21.042 any proposed rule that is |
|---|
| 14 | 14 | | reasonably likely to affect educators or educator preparation |
|---|
| 15 | 15 | | programs, the board must use negotiated rulemaking procedures under |
|---|
| 16 | 16 | | Chapter 2008, Government Code, including the appointment to a |
|---|
| 17 | 17 | | negotiated rulemaking committee of persons representing, as |
|---|
| 18 | 18 | | appropriate: |
|---|
| 19 | 19 | | (1) educators; |
|---|
| 20 | 20 | | (2) educator preparation programs; and |
|---|
| 21 | 21 | | (3) membership organizations that represent educators |
|---|
| 22 | 22 | | or educator preparation programs. |
|---|
| 23 | 23 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 24 | 24 | | to a rule proposed by the State Board for Educator Certification on |
|---|
| 25 | 25 | | or after the effective date of this Act. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect September 1, 2023. |
