| 9 | 9 | | Human Services Commission for day-care centers. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter G, Chapter 37, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 37.2135 to read as follows: |
|---|
| 13 | 13 | | Sec. 37.2135. DAY-CARE CENTERS. (a) In this section, |
|---|
| 14 | 14 | | "day-care center" has the meaning assigned by Section 42.002, Human |
|---|
| 15 | 15 | | Resources Code. |
|---|
| 16 | 16 | | (b) The center, in collaboration with the Health and Human |
|---|
| 17 | 17 | | Services Commission, shall: |
|---|
| 18 | 18 | | (1) research best practices regarding emergency |
|---|
| 19 | 19 | | preparedness of day-care centers and serve as a clearinghouse for |
|---|
| 20 | 20 | | that information; |
|---|
| 21 | 21 | | (2) develop safety and security audit procedures for |
|---|
| 22 | 22 | | day-care centers that include: |
|---|
| 23 | 23 | | (A) the frequency of the safety and security |
|---|
| 24 | 24 | | audit to be conducted by a day-care center under Section 42.04432, |
|---|
| 25 | 25 | | Human Resources Code; and |
|---|
| 26 | 26 | | (B) the manner in which a day-care center must |
|---|
| 27 | 27 | | report the results of the safety and security audit conducted under |
|---|
| 28 | 28 | | Section 42.04432, Human Resources Code, to the center; |
|---|
| 29 | 29 | | (3) develop and publish guidelines for standard |
|---|
| 30 | 30 | | emergency response protocol requirements; and |
|---|
| 31 | 31 | | (4) provide day-care centers with safety and standard |
|---|
| 32 | 32 | | emergency response protocol training and technical assistance. |

| 33 | 33 | | SECTION 2. Subchapter C, Chapter 42, Human Resources Code, |
|---|
| 34 | 34 | | is amended by adding Section 42.04432 to read as follows: |
|---|
| 35 | 35 | | Sec. 42.04432. EMERGENCY RESPONSE PROTOCOL FOR AND SAFETY |
|---|
| 36 | 36 | | AND SECURITY AUDIT OF CERTAIN FACILITIES. (a) In this section, |
|---|
| 37 | 37 | | "center" means the Texas School Safety Center. |
|---|
| 38 | 38 | | (b) Each day-care center shall: |
|---|
| 39 | 39 | | (1) follow the standard emergency response protocol |
|---|
| 40 | 40 | | guidelines developed by the center, in collaboration with the |
|---|
| 41 | 41 | | commission as required by Section 37.2135, Education Code; |
|---|
| 42 | 42 | | (2) conduct safety and security audits following the |
|---|
| 43 | 43 | | safety and security audit procedures developed by the center, in |
|---|
| 44 | 44 | | collaboration with the commission under Section 37.2135, Education |
|---|
| 45 | 45 | | Code; and |
|---|
| 46 | 46 | | (3) report the results of the safety and security |
|---|
| 47 | 47 | | audit conducted under Subdivision (2) to the center in the manner |
|---|
| 48 | 48 | | required by Section 37.2135, Education Code. |
|---|
| 49 | 49 | | SECTION 3. As soon as practicable after the effective date |
|---|
| 50 | 50 | | of this Act, the Texas School Safety Center and the Health and Human |
|---|
| 51 | 51 | | Services Commission shall develop the procedures and guidelines |
|---|
| 52 | 52 | | required by Section 37.2135, Education Code, and Section 42.04432, |
|---|
| 53 | 53 | | Human Resources Code, as added by this Act. |
|---|
| 54 | 54 | | SECTION 4. This Act takes effect September 1, 2023. |
