A BILL TO BE ENTITLED
AN ACT
relating to eligibility for appointment to the board of managers of
a school district or open-enrollment charter school.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 39A.204, Education Code, is amended to
read as follows:
Sec. 39A.204. QUALIFICATIONS AND COMPOSITION OF BOARD OF
MANAGERS. (a) The commissioner may not appoint an individual to a
board of managers unless the individual is eligible to be elected as
a trustee of a school district under Subchapter C, Chapter 11, of
this code and Section 141.001, Election Code.
(b) A board of managers appointed by the commissioner must,
if possible, include community leaders, business representatives
who have expertise in leadership, and individuals who have
knowledge or expertise in the field of education.
SECTION 2. Section 39A.204, Education Code, as amended by
this Act, applies beginning with appointments made to a board of
managers of a school district or open-enrollment charter school on
or after the effective date of this Act.
SECTION 3. This Act takes effect September 1, 2023.
