| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 39A.204, Education Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | Sec. 39A.204. QUALIFICATIONS AND COMPOSITION OF BOARD OF |
|---|
| 13 | 13 | | MANAGERS. (a) The commissioner may not appoint an individual to a |
|---|
| 14 | 14 | | board of managers unless the individual is eligible to be elected as |
|---|
| 15 | 15 | | a trustee of a school district under Subchapter C, Chapter 11, of |
|---|
| 16 | 16 | | this code and Section 141.001, Election Code. |
|---|
| 17 | 17 | | (b) A board of managers appointed by the commissioner must, |
|---|
| 18 | 18 | | if possible, include community leaders, business representatives |
|---|
| 19 | 19 | | who have expertise in leadership, and individuals who have |
|---|
| 20 | 20 | | knowledge or expertise in the field of education. |
|---|
| 21 | 21 | | SECTION 2. Section 39A.204, Education Code, as amended by |
|---|
| 22 | 22 | | this Act, applies beginning with appointments made to a board of |
|---|
| 23 | 23 | | managers of a school district or open-enrollment charter school on |
|---|
| 24 | 24 | | or after the effective date of this Act. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect September 1, 2023. |
