55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the electronic filing with the Texas Ethics Commission
88 of certain reports of political contributions and expenditures.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 254, Election Code, is
1111 amended by adding Section 254.0365 to read as follows:
1212 Sec. 254.0365. ELECTRONIC FILING OF CERTAIN REPORTS
1313 REQUIRED. (a) This section does not apply to a candidate or
1414 officeholder for a judicial office subject to Subchapter F, Chapter
1515 253.
1616 (b) Notwithstanding any other law, a candidate or
1717 officeholder who is required to file reports with the commission
1818 shall file the reports electronically if in a calendar year the
1919 candidate or officeholder:
2020 (1) accepts political contributions that in the
2121 aggregate exceed $25,000; or
2222 (2) makes political expenditures that in the aggregate
2323 exceed $25,000.
2424 (c) The commission shall make each report filed in
2525 accordance with this section available to the public on the
2626 commission's Internet website not later than the seventh business
2727 day after the date the report is filed.
2828 SECTION 2. The changes in law made by this Act apply only to
2929 a report of political contributions and expenditures under Chapter
3030 254, Election Code, that is required to be filed on or after January
3131 1, 2024. A report under that chapter that is required to be filed
3232 before the effective date of this Act is governed by the law in
3333 effect on the date the report is required to be filed, and the
3434 former law is continued in effect for that purpose.
3535 SECTION 3. This Act takes effect September 1, 2023.
