66 AN ACT
77 relating to the creation of the Atascosa County Municipal Utility
88 District No. 2; granting a limited power of eminent domain;
99 providing authority to issue bonds; providing authority to impose
1010 assessments, fees, and taxes.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1313 Code, is amended by adding Chapter 7957A to read as follows:
1414 CHAPTER 7957A. ATASCOSA COUNTY MUNICIPAL UTILITY DISTRICT NO. 2
1515 SUBCHAPTER A. GENERAL PROVISIONS
1616 Sec. 7957A.0101. DEFINITIONS. In this chapter:
1717 (1) "Board" means the district's board of directors.
1818 (2) "Commission" means the Texas Commission on
1919 Environmental Quality.
2020 (3) "Director" means a board member.
2121 (4) "District" means the Atascosa County Municipal
2222 Utility District No. 2.
2323 Sec. 7957A.0102. NATURE OF DISTRICT. The district is a
2424 municipal utility district created under Section 59, Article XVI,
2525 Texas Constitution.
2626 Sec. 7957A.0103. CONFIRMATION AND DIRECTOR ELECTION
2727 REQUIRED. The temporary directors shall hold an election to
2828 confirm the creation of the district and to elect five permanent
2929 directors as provided by Section 49.102, Water Code.
3030 Sec. 7957A.0104. CONSENT OF MUNICIPALITY REQUIRED. The
3131 temporary directors may not hold an election under Section
3232 7957A.0103 until each municipality in whose corporate limits or
3333 extraterritorial jurisdiction the district is located has
3434 consented by ordinance or resolution to the creation of the
3535 district and to the inclusion of land in the district.
3636 Sec. 7957A.0105. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
3737 (a) The district is created to serve a public purpose and benefit.
3838 (b) The district is created to accomplish the purposes of:
3939 (1) a municipal utility district as provided by
4040 general law and Section 59, Article XVI, Texas Constitution; and
4141 (2) Section 52, Article III, Texas Constitution, that
4242 relate to the construction, acquisition, improvement, operation,
4343 or maintenance of macadamized, graveled, or paved roads, or
4444 improvements, including storm drainage, in aid of those roads.
4545 Sec. 7957A.0106. INITIAL DISTRICT TERRITORY. (a) The
4646 district is initially composed of the territory described by
4747 Section 2 of the Act enacting this chapter.
4848 (b) The boundaries and field notes contained in Section 2 of
4949 the Act enacting this chapter form a closure. A mistake made in the
5050 field notes or in copying the field notes in the legislative process
5151 does not affect the district's:
5252 (1) organization, existence, or validity;
5353 (2) right to issue any type of bond for the purposes
5454 for which the district is created or to pay the principal of and
5555 interest on a bond;
5656 (3) right to impose a tax; or
5757 (4) legality or operation.
5858 SUBCHAPTER B. BOARD OF DIRECTORS
5959 Sec. 7957A.0201. GOVERNING BODY; TERMS. (a) The district
6060 is governed by a board of five elected directors.
6161 (b) Except as provided by Section 7957A.0202, directors
6262 serve staggered four-year terms.
6363 Sec. 7957A.0202. TEMPORARY DIRECTORS. (a) The temporary
6464 board consists of:
6565 (1) Bruce Bartlett;
6666 (2) G. Bailey Woods, Jr.;
6767 (3) Sloan Thomas;
6868 (4) Andrew B. Price; and
6969 (5) Foard Houston.
7070 (b) Temporary directors serve until the earlier of:
7171 (1) the date permanent directors are elected under
7272 Section 7957A.0103; or
7373 (2) the fourth anniversary of the effective date of
7474 the Act enacting this chapter.
7575 (c) If permanent directors have not been elected under
7676 Section 7957A.0103 and the terms of the temporary directors have
7777 expired, successor temporary directors shall be appointed or
7878 reappointed as provided by Subsection (d) to serve terms that
7979 expire on the earlier of:
8080 (1) the date permanent directors are elected under
8181 Section 7957A.0103; or
8282 (2) the fourth anniversary of the date of the
8383 appointment or reappointment.
8484 (d) If Subsection (c) applies, the owner or owners of a
8585 majority of the assessed value of the real property in the district
8686 may submit a petition to the commission requesting that the
8787 commission appoint as successor temporary directors the five
8888 persons named in the petition. The commission shall appoint as
8989 successor temporary directors the five persons named in the
9090 petition.
9191 SUBCHAPTER C. POWERS AND DUTIES
9292 Sec. 7957A.0301. GENERAL POWERS AND DUTIES. The district
9393 has the powers and duties necessary to accomplish the purposes for
9494 which the district is created.
9595 Sec. 7957A.0302. MUNICIPAL UTILITY DISTRICT POWERS AND
9696 DUTIES. The district has the powers and duties provided by the
9797 general law of this state, including Chapters 49 and 54, Water Code,
9898 applicable to municipal utility districts created under Section 59,
9999 Article XVI, Texas Constitution.
100100 Sec. 7957A.0303. AUTHORITY FOR ROAD PROJECTS. Under
101101 Section 52, Article III, Texas Constitution, the district may
102102 design, acquire, construct, finance, issue bonds for, improve,
103103 operate, maintain, and convey to this state, a county, or a
104104 municipality for operation and maintenance macadamized, graveled,
105105 or paved roads, or improvements, including storm drainage, in aid
106106 of those roads.
107107 Sec. 7957A.0304. ROAD STANDARDS AND REQUIREMENTS. (a) A
108108 road project must meet all applicable construction standards,
109109 zoning and subdivision requirements, and regulations of each
110110 municipality in whose corporate limits or extraterritorial
111111 jurisdiction the road project is located.
112112 (b) If a road project is not located in the corporate limits
113113 or extraterritorial jurisdiction of a municipality, the road
114114 project must meet all applicable construction standards,
115115 subdivision requirements, and regulations of each county in which
116116 the road project is located.
117117 (c) If the state will maintain and operate the road, the
118118 Texas Transportation Commission must approve the plans and
119119 specifications of the road project.
120120 Sec. 7957A.0305. COMPLIANCE WITH MUNICIPAL CONSENT
121121 ORDINANCE OR RESOLUTION. The district shall comply with all
122122 applicable requirements of any ordinance or resolution that is
123123 adopted under Section 54.016 or 54.0165, Water Code, and that
124124 consents to the creation of the district or to the inclusion of land
125125 in the district.
126126 Sec. 7957A.0306. DIVISION OF DISTRICT. (a) The district
127127 may be divided into two or more new districts only if the district:
128128 (1) has no outstanding bonded debt; and
129129 (2) is not imposing ad valorem taxes.
130130 (b) This chapter applies to any new district created by the
131131 division of the district, and a new district has all the powers and
132132 duties of the district.
133133 (c) A new district created by the division of the district
134134 may not, at the time the new district is created, contain any land
135135 outside the area described by Section 2 of the Act enacting this
136136 chapter.
137137 (d) The board, on its own motion or on receipt of a petition
138138 signed by the owner or owners of a majority of the assessed value of
139139 the real property in the district, may adopt an order dividing the
140140 district.
141141 (e) The board may adopt an order dividing the district
142142 before or after the date the board holds an election under Section
143143 7957A.0103 to confirm the district's creation.
144144 (f) An order dividing the district must:
145145 (1) name each new district;
146146 (2) include the metes and bounds description of the
147147 territory of each new district;
148148 (3) appoint temporary directors for each new district;
149149 and
150150 (4) provide for the division of assets and liabilities
151151 between or among the new districts.
152152 (g) On or before the 30th day after the date of adoption of
153153 an order dividing the district, the district shall file the order
154154 with the commission and record the order in the real property
155155 records of each county in which the district is located.
156156 (h) Any new district created by the division of the district
157157 shall hold a confirmation and directors' election as required by
158158 Section 7957A.0103.
159159 (i) If the creation of the new district is confirmed, the
160160 new district shall provide the election date and results to the
161161 commission.
162162 (j) Any new district created by the division of the district
163163 must hold an election as required by this chapter to obtain voter
164164 approval before the district may impose a maintenance tax or issue
165165 bonds payable wholly or partly from ad valorem taxes.
166166 (k) Municipal consent to the creation of the district and to
167167 the inclusion of land in the district granted under Section
168168 7957A.0104 acts as municipal consent to the creation of any new
169169 district created by the division of the district and to the
170170 inclusion of land in the new district.
171171 Sec. 7957A.0307. STRATEGIC PARTNERSHIP AGREEMENT. The
172172 district may negotiate and enter into a written strategic
173173 partnership agreement with a municipality under Section 43.0751,
174174 Local Government Code.
175175 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
176176 Sec. 7957A.0401. ELECTIONS REGARDING TAXES OR BONDS. (a)
177177 The district may issue, without an election, bonds and other
178178 obligations secured by:
179179 (1) revenue other than ad valorem taxes; or
180180 (2) contract payments described by Section
181181 7957A.0403.
182182 (b) The district must hold an election in the manner
183183 provided by Chapters 49 and 54, Water Code, to obtain voter approval
184184 before the district may impose an ad valorem tax or issue bonds
185185 payable from ad valorem taxes.
186186 (c) The district may not issue bonds payable from ad valorem
187187 taxes to finance a road project unless the issuance is approved by a
188188 vote of a two-thirds majority of the district voters voting at an
189189 election held for that purpose.
190190 Sec. 7957A.0402. OPERATION AND MAINTENANCE TAX. (a) If
191191 authorized at an election held under Section 7957A.0401, the
192192 district may impose an operation and maintenance tax on taxable
193193 property in the district in accordance with Section 49.107, Water
194194 Code.
195195 (b) The board shall determine the tax rate. The rate may not
196196 exceed the rate approved at the election.
197197 Sec. 7957A.0403. CONTRACT TAXES. (a) In accordance with
198198 Section 49.108, Water Code, the district may impose a tax other than
199199 an operation and maintenance tax and use the revenue derived from
200200 the tax to make payments under a contract after the provisions of
201201 the contract have been approved by a majority of the district voters
202202 voting at an election held for that purpose.
203203 (b) A contract approved by the district voters may contain a
204204 provision stating that the contract may be modified or amended by
205205 the board without further voter approval.
206206 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
207207 Sec. 7957A.0501. AUTHORITY TO ISSUE BONDS AND OTHER
208208 OBLIGATIONS. The district may issue bonds or other obligations
209209 payable wholly or partly from ad valorem taxes, impact fees,
210210 revenue, contract payments, grants, or other district money, or any
211211 combination of those sources, to pay for any authorized district
212212 purpose.
213213 Sec. 7957A.0502. TAXES FOR BONDS. At the time the district
214214 issues bonds payable wholly or partly from ad valorem taxes, the
215215 board shall provide for the annual imposition of a continuing
216216 direct ad valorem tax, without limit as to rate or amount, while all
217217 or part of the bonds are outstanding as required and in the manner
218218 provided by Sections 54.601 and 54.602, Water Code.
219219 Sec. 7957A.0503. BONDS FOR ROAD PROJECTS. At the time of
220220 issuance, the total principal amount of bonds or other obligations
221221 issued or incurred to finance road projects and payable from ad
222222 valorem taxes may not exceed one-fourth of the assessed value of the
223223 real property in the district.
224224 SECTION 2. The Atascosa County Municipal Utility District
225225 No. 2 initially includes all the territory contained in the
226226 following area:
227227 Being a boundary survey of 0.616 acre, more or less, of land
228228 lying in Atascosa County, Texas, being out of and a part of E.S.
229229 Harper Survey 1202, Abstract No. 366, Atascosa County, Texas. Said
230230 0.616 acre being bounded on the northwest by the fenced
231231 southeasterly margin of F.M. 1470 (Leming Drive); on the northeast
232232 by 11.25 acres, James P. Shone, et ux., Book 857, Page 700 of the
233233 Atascosa County Deed Records; and on the southeast by 4.52 acres
234234 simultaneously surveyed this same day. Said 0.616 acre being more
235235 particularly described by metes and bounds as follows: (The
236236 courses, distances, areas and any coordinates cited herein or shown
237237 on the corresponding survey plat conform to the Texas Coordinate
238238 System, North American Datum 1983, Texas South Central Zone.) (All
239239 corners called for as being set are marked on the ground with 1/2"
240240 diameter rebar with plastic identification caps stamped
241241 "RPLS/6418" attached unless otherwise noted or shown.)
242242 BEGINNING at a found broken TxDOT Type I right-of-way
243243 monument at the intersection of F.M. 1470 and an unnamed county
244244 road, marking a deflection point of the herein described tract;
245245 THENCE: N 26° 16' 04" E, with the southwesterly margin of F.M.
246246 1470 and the herein described tract for a distance of 25.94 feet to
247247 a 3" diameter pipe 3-way fence corner post at a point on the
248248 ostensible common survey line of said Survey 1202 and I. Wautz
249249 Survey 1176, Abstract No. 895, marking a deflection point of said
250250 11.25 acres, and marking the north corner of the herein described
251251 tract, from which a found TxDOT Type I right-of-way monument bears N
252252 15° 48' 34" E at a distance of 24.43 feet;
253253 THENCE: S 35° 21' 31" E, generally with the fence, with the
254254 ostensible common survey line of said Survey 1202 and said Survey
255255 1176, and with the common boundary line of said 11.25 acres and the
256256 herein described tract for a distance of 1154.04 feet to a 3"
257257 diameter pipe fence angle post marking a deflection point of said
258258 11.25 acres, marking the west corner of said 4.52 acres, and marking
259259 a deflection point of the herein described tract;
260260 THENCE: S 56° 44' 15" E, with the common boundary line of said
261261 4.52 acres and the herein described tract for a distance of 50.89
262262 feet to an unmarked corner marking a deflection point of said 4.52
263263 acres, and marking the east corner of the herein described tract;
264264 THENCE: With the southwesterly margin of said unnamed county
265265 road and the herein described tract for the following two (2) calls:
266266 1.) N 79° 52' 38" W, for a distance of 59.02 feet to an
267267 unmarked corner marking a deflection point of the herein described
268268 tract;
269269 2.) N 35° 21' 31" W, for a distance of 1147.02 feet to

357357 Place of Beginning and containing 101.73 acres, more or less, of
358358 land within the herein described boundary, according to an actual
359359 on the ground survey made by Smyth Surveyors, Inc. and completed on
360360 October 19, 2022.
361361 Being a boundary survey of 404.48 acres, more or less, of land
362362 lying in Atascosa County, Texas, being out of and parts of N. Mcada
363363 Survey 1198, Abstract No. 566, I. Wautz Survey 1175, Abstract
364364 No. 896, M. Moritz Survey 1292, Abstract No. 586, G. Hectorne
365365 Survey 1199, Abstract No. 370, and W. Morrow Survey 1200, Abstract
366366 No. 589, being out of and a part of John T. Horton Ranch, recorded
367367 in Slide 25-A of the Atascosa County New Plat Cabinet, and also

378378 Records, and 4.) 11.25 acres, James P. Shone, et ux., Book 857, Page
379379 700 of the Atascosa County Deed Records; on the southeast by the
380380 fenced northwesterly margin of Red Barn Road; and on the southwest
381381 by the following: 1.) 100 acres, Carolyn Daniel, Document Number

838838 unmarked corner marking a deflection point of the herein described
839839 tract, from which point a 4.5" diameter pipe fence angle post bears
840840 N 53° 54' 38" W at a distance of 2.48 feet;
841841 2.) S 65° 54' 36" W, passing the ostensible common survey
842842 line of said Survey 1292 and said Survey 1175, continuing on the
843843 same course, at 1137.84 feet passing a found TxDOT Type II
844844 right-of-way monument, continuing on the same course, at 2637.64
845845 feet passing a found TxDOT Type II right-of-way monument,
846846 continuing on the same course, at 3121.06 feet passing a found TxDOT
847847 Type II right-of-way monument, continuing on the same course, at
848848 4637.23 feet passing 1.12 feet to the right of a found TxDOT Type II
849849 right-of-way monument, continuing on the same course, for a total
850850 distance of 4858.45 feet to the Place of Beginning and containing
851851 399.52 acres, more or less, of land within the herein described
852852 boundary, according to an actual on the ground survey made by D. G.
853853 Smyth & Co., Inc. and completed on August 26, 2022.
854854 SECTION 3. (a) The legal notice of the intention to
855855 introduce this Act, setting forth the general substance of this
856856 Act, has been published as provided by law, and the notice and a
857857 copy of this Act have been furnished to all persons, agencies,
858858 officials, or entities to which they are required to be furnished
859859 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
860860 Government Code.
861861 (b) The governor, one of the required recipients, has
862862 submitted the notice and Act to the Texas Commission on
863863 Environmental Quality.
864864 (c) The Texas Commission on Environmental Quality has filed
865865 its recommendations relating to this Act with the governor, the
866866 lieutenant governor, and the speaker of the house of
867867 representatives within the required time.
868868 (d) All requirements of the constitution and laws of this
869869 state and the rules and procedures of the legislature with respect
870870 to the notice, introduction, and passage of this Act are fulfilled
871871 and accomplished.
872872 SECTION 4. (a) If this Act does not receive a two-thirds
873873 vote of all the members elected to each house, Subchapter C, Chapter
874874 7957A, Special District Local Laws Code, as added by Section 1 of
875875 this Act, is amended by adding Section 7957A.0308 to read as
876876 follows:
877877 Sec. 7957A.0308. NO EMINENT DOMAIN POWER. The district may
878878 not exercise the power of eminent domain.
879879 (b) This section is not intended to be an expression of a
880880 legislative interpretation of the requirements of Section 17(c),
881881 Article I, Texas Constitution.
882882 SECTION 5. This Act takes effect immediately if it receives
883883 a vote of two-thirds of all the members elected to each house, as
884884 provided by Section 39, Article III, Texas Constitution. If this
885885 Act does not receive the vote necessary for immediate effect, this
886886 Act takes effect September 1, 2023.
