| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 5001.101, Special District Local Laws |
|---|
| 11 | 11 | | Code, is amended to read as follows: |
|---|
| 12 | 12 | | Sec. 5001.101. PURCHASE OR LEASE OF PROPERTY. (a) Except |
|---|
| 13 | 13 | | as provided by Subsections (b) and (c), the [The] district may |
|---|
| 14 | 14 | | purchase or lease property in the same manner as a county. |
|---|
| 15 | 15 | | (b) The district may lease the surface of land, including |
|---|
| 16 | 16 | | submerged land, for not more than 90 years. The lease may not be |
|---|
| 17 | 17 | | extended beyond the 90-year period by renewal, extension, or |
|---|
| 18 | 18 | | otherwise. |
|---|
| 19 | 19 | | (c) The district may not enter into or extend a lease of |
|---|
| 20 | 20 | | property under this section for use in: |
|---|
| 21 | 21 | | (1) the conduct of gaming or wagering activities |
|---|
| 22 | 22 | | authorized under Subtitles A and A-1, Title 13, Occupations Code; |
|---|
| 23 | 23 | | (2) the conduct of gambling prohibited under Chapter |
|---|
| 24 | 24 | | 47, Penal Code; or |
|---|
| 25 | 25 | | (3) the establishment of a casino or other similar |
|---|
| 26 | 26 | | gaming facility. |
|---|
| 27 | 27 | | SECTION 2. This Act takes effect September 1, 2023. |
