| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter Y, Chapter 201, Transportation Code, |
|---|
| 11 | 11 | | is amended by adding Section 201.2004 to read as follows: |
|---|
| 12 | 12 | | Sec. 201.2004. EDUARDO "EDDIE" GRACIA, JR., P.E. AREA |
|---|
| 13 | 13 | | ENGINEER AND MAINTENANCE FACILITY. (a) The building in which, on |
|---|
| 14 | 14 | | June 1, 2023, is located the office of the area engineer for Starr |
|---|
| 15 | 15 | | County is designated as the Eduardo "Eddie" Gracia, Jr., P.E. Area |
|---|
| 16 | 16 | | Engineer and Maintenance Facility. |
|---|
| 17 | 17 | | (b) Subject to Subsection (a), the department shall: |
|---|
| 18 | 18 | | (1) design and construct markers on the site |
|---|
| 19 | 19 | | indicating the designation as the Eduardo "Eddie" Gracia, Jr., P.E. |
|---|
| 20 | 20 | | Area Engineer and Maintenance Facility and any other appropriate |
|---|
| 21 | 21 | | information; and |
|---|
| 22 | 22 | | (2) erect a marker at appropriate intermediate sites |
|---|
| 23 | 23 | | along the highway. |
|---|
| 24 | 24 | | (c) Notwithstanding Subsection (b), the department is not |
|---|
| 25 | 25 | | required to design, construct, or erect a marker under this section |
|---|
| 26 | 26 | | unless a grant or donation of private funds is made to the |
|---|
| 27 | 27 | | department to cover the cost of the design, construction, and |
|---|
| 28 | 28 | | erection of the marker. |
|---|
| 29 | 29 | | (d) Money received under Subsection (c) shall be deposited |
|---|
| 30 | 30 | | to the credit of the state highway fund. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2023. |
