66 relating to the commissioning by the General Land Office of certain
77 Alamo complex rangers as peace officers.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Article 2.12, Code of Criminal Procedure, is
1010 amended to read as follows:
1111 Art. 2.12. WHO ARE PEACE OFFICERS. The following are peace
1212 officers:
1313 (1) sheriffs, their deputies, and those reserve
1414 deputies who hold a permanent peace officer license issued under
1515 Chapter 1701, Occupations Code;
1616 (2) constables, deputy constables, and those reserve
1717 deputy constables who hold a permanent peace officer license issued
1818 under Chapter 1701, Occupations Code;
1919 (3) marshals or police officers of an incorporated
2020 city, town, or village, and those reserve municipal police officers
2121 who hold a permanent peace officer license issued under Chapter
2222 1701, Occupations Code;
2323 (4) rangers, officers, and members of the reserve
2424 officer corps commissioned by the Public Safety Commission and the
2525 Director of the Department of Public Safety;
2626 (5) investigators of the district attorneys', criminal
2727 district attorneys', and county attorneys' offices;
2828 (6) law enforcement agents of the Texas Alcoholic
2929 Beverage Commission;
3030 (7) each member of an arson investigating unit
3131 commissioned by a city, a county, or the state;
3232 (8) officers commissioned under Section 37.081,
3333 Education Code, or Subchapter E, Chapter 51, Education Code;
3434 (9) officers commissioned by the General Services
3535 Commission;
3636 (10) law enforcement officers commissioned by the
3737 Parks and Wildlife Commission;
3838 (11) officers commissioned under Chapter 23,
3939 Transportation Code;
4040 (12) municipal park and recreational patrolmen and
4141 security officers;
4242 (13) security officers and investigators commissioned
4343 as peace officers by the comptroller;
4444 (14) officers commissioned by a water control and
4545 improvement district under Section 49.216, Water Code;
4646 (15) officers commissioned by a board of trustees
4747 under Chapter 54, Transportation Code;
4848 (16) investigators commissioned by the Texas Medical
4949 Board;
5050 (17) officers commissioned by:
5151 (A) the board of managers of the Dallas County
5252 Hospital District, the Tarrant County Hospital District, the Bexar
5353 County Hospital District, or the El Paso County Hospital District
5454 under Section 281.057, Health and Safety Code;
5555 (B) the board of directors of the Ector County
5656 Hospital District under Section 1024.117, Special District Local
5757 Laws Code;
5858 (C) the board of directors of the Midland County
5959 Hospital District of Midland County, Texas, under Section 1061.121,
6060 Special District Local Laws Code; and
6161 (D) the board of hospital managers of the Lubbock
6262 County Hospital District of Lubbock County, Texas, under Section
6363 1053.113, Special District Local Laws Code;
6464 (18) county park rangers commissioned under
6565 Subchapter E, Chapter 351, Local Government Code;
6666 (19) investigators employed by the Texas Racing
6767 Commission;
6868 (20) officers commissioned under Chapter 554,
6969 Occupations Code;
7070 (21) officers commissioned by the governing body of a
7171 metropolitan rapid transit authority under Section 451.108,
7272 Transportation Code, or by a regional transportation authority
7373 under Section 452.110, Transportation Code;
7474 (22) investigators commissioned by the attorney
7575 general under Section 402.009, Government Code;
7676 (23) security officers and investigators commissioned
7777 as peace officers under Chapter 466, Government Code;
7878 (24) officers appointed by an appellate court under
7979 Subchapter F, Chapter 53, Government Code;
8080 (25) officers commissioned by the state fire marshal
8181 under Chapter 417, Government Code;
8282 (26) an investigator commissioned by the commissioner
8383 of insurance under Section 701.104, Insurance Code;
8484 (27) apprehension specialists and inspectors general
8585 commissioned by the Texas Juvenile Justice Department as officers
8686 under Sections 242.102 and 243.052, Human Resources Code;
8787 (28) officers appointed by the inspector general of
8888 the Texas Department of Criminal Justice under Section 493.019,
8989 Government Code;
9090 (29) investigators commissioned by the Texas
9191 Commission on Law Enforcement under Section 1701.160, Occupations
9292 Code;
9393 (30) commission investigators commissioned by the
9494 Texas Private Security Board under Section 1702.061, Occupations
9595 Code;
9696 (31) the fire marshal and any officers, inspectors, or
9797 investigators commissioned by an emergency services district under
9898 Chapter 775, Health and Safety Code;
9999 (32) officers commissioned by the State Board of
100100 Dental Examiners under Section 254.013, Occupations Code, subject
101101 to the limitations imposed by that section;
102102 (33) investigators commissioned by the Texas Juvenile
103103 Justice Department as officers under Section 221.011, Human
104104 Resources Code; [and]
105105 (34) the fire marshal and any related officers,
106106 inspectors, or investigators commissioned by a county under
107107 Subchapter B, Chapter 352, Local Government Code; and
108108 (35) Alamo complex rangers commissioned by the General
109109 Land Office under Section 31.0515, Natural Resources Code, subject
110110 to the limitations imposed by that section.
111111 SECTION 2. Section 31.0515, Natural Resources Code, is
112112 amended to read as follows:
113113 Sec. 31.0515. DUTIES RELATED TO THE ALAMO COMPLEX. (a) The
114114 land office shall:
115115 (1) employ staff necessary to preserve and maintain
116116 the Alamo complex and contract for professional services of
117117 qualified consultants; [and]
118118 (2) commission as a peace officer an Alamo complex
119119 ranger who has been certified as qualified to be a peace officer by
120120 the Texas Commission on Law Enforcement; and
121121 (3) prepare an annual budget and work plan, including
122122 preservation, future construction, and usual maintenance for the
123123 Alamo complex, including buildings on the Alamo property, their
124124 contents, and their grounds.
125125 (b) An Alamo complex ranger commissioned as a peace officer
126126 under this section has the powers, privileges, and immunities of a
127127 peace officer while carrying out duties as an Alamo complex ranger
128128 under this section.
129129 SECTION 3. This Act takes effect September 1, 2023.
