44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to repealing the affirmative defense to prosecution for
77 the criminal offense of sale, distribution, or display of harmful
88 material to a minor.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 43.24(c), Penal Code, is repealed.
1111 SECTION 2. The change in law made by this Act applies only
1212 to an offense committed on or after the effective date of this Act.
1313 An offense committed before the effective date of this Act is
1414 governed by the law in effect on the date the offense was committed,
1515 and the former law is continued in effect for that purpose. For
1616 purposes of this section, an offense was committed before the
1717 effective date of this Act if any element of the offense occurred
1818 before that date.
1919 SECTION 3. This Act takes effect September 1, 2023.
